AN ORDINANCE
AMENDING CHAPTER 19, FOOD AND FOOD ESTABLISHMENTS, SECTION
19-75, CERTIFICATION, BY ESTABLISHING A FEE OF $3.00 FOR
CERTIFICATES ISSUED BY THE HEALTH DEPARTMENT TO EMPLOYEES OF
FOOD SERVICE ESTABLISHMENTS ON COMPLETION OF REQUIRED
TRAINING, AND REQUIRING NEW EMPLOYEES TO COMPLETE TRAINING
BEFORE STARTING WORK; PROVIDING FOR SEVERANCE; AND PROVIDING
FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Section 29-75, Certification, of Chapter 19, Food and
Food Establishments, is hereby amended to read as follows:
Sec. 19-75. Certification. The employers will notify the
health department, in writing, of the maximum number of
persons to be employed in food service or food processing
establishment or mobile food unit, and further will certify
that they will provide training for all employees and ensure
that such employees will satisfactorily perform their duties
in accordance with food service sanitation ordinances, rules
and regulations. Such training will be provided by the
health department upon request. A fee of $3.00 will be
charged for each certificate issued by the health department
upon completion of such training. Satisfactory training for
employees must be completed before an employee can start to
work. Additional training must be provided for employees at
least every three (3) years to maintain certification.
Evidence of satisfactory training will be demonstrated by
health department inspections of the food service operation.
If inadequate hygienic performance is demonstrated by the
employees, the food service or food processing establishment
or mobile food unit will be required to have all employees
attend training in food hygiene at a course conducted by the
city health department at a time and place prescribed by the
health department.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
