AUTHORIZING THE AMENDMENT OF AN AGREEMENT WITH FEDERAL
AVIATION ADMINISTRATION, NO. DTFA07-83-L-01065,
PROVIDING FOR THE ADDITION OF VARIOUS NAVIGATIONAL AIDS
FOR RUNWAYS 13-31 AND 17-35 AND OTHER LEASE TERMS
REMAINING UNCHANGED EFFECTIVE OCTOBER 1, 1985; ALL AS
MORE FULLY DESCRIBED IN THE ATTACHED AGREEMENT MARKED
EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
an agreement with the Federal Aviation Administration for the addition of
various navigational aids for runways 13-31 and 17-35 and other lease terms
remaining unchanged, all as more fully set forth in plans and
specifications, and agreement attached hereto and lease documents on file
in the office of the City Secretary, all of which are made a part hereof by
reference.
SECTION 3. That upon written request of the Mayor or five
Council members, copy attached, to find and declare an emergency due to the
need to take immediate action to preserve and protect public property by
expediting the construction of public improvements, such finding of an
emergency is made and declared requiring suspension of the Charter rule as
to consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the 23rd day of July, 1985.

SUPPLEMENTAL AGREEMENT NO. 1
THIS SUPPLEMENTAL AGREEMENT, made and entered into this day
of 1985, by and between the UNITED STATES OF AMERICA, hereinafter
called the Government, and the CITY OF CORPUS CHRISTI, TEXAS, hereinafter
called the Lessor, whose address Route 2, Box 902, Corpus Christi, Texas
78408, WITNESSETH, That:
WHEREAS on the 5th day of April 1983, the parties hereunto entered
into Lease No. DTFA07-83-L-01065, for the consideration and purposes more
particularly stated in said lease; and
WHEREAS, it is to. the benefit of both parties to incorporate the
facilities that are covered in License No. DOT-FA767SW-1010 which expires
September 30, 1985 into Lease DTFA07-83-L-01065 as follows:
VASI: A tract Cif -land located on the'Corpus Christi International
Airport, Nueees County, Corpus Christi, Texas, Runway 17 for a Visual
Approach Slope 4Indioator, including the right to install, maintain, and
operate power and .control cables as shown on Drawing No. SW -D-8785-1,
dated April 8, 1976, marked Exhibit "A," attached hereto and made a part
hereof.
REILS: A tract of land located on the' Corpus Christi International
Airport, Nueees County, Corpus Christi, Texas, for two (2) Runway End
Identifier Lights on Runway 17 and Runway 35, inoluding the right to
install, maintain, and operate power and control oables, as shown on
Drawing No. SW -D-8785-1, dated April 8, 1976, marked Exhibit "A," attached
hereto and made a part hereof.
APPROACH LIGHTING SYSTEM AND ELECTRONIC FLASHING APPROACH LIGHT SITE: A
tract of land on and adjoining the Corpus Christi International Airport,
Nueees County, Corpus Christi, Texas, Runway 13 and more particularly
described as follows: Starting at a point on the center of the northwest
end of the NW/SE Runway, said point to be the Point of Beginning, proceed
S45°47'38"W 150 feet; thenoe N44°12'22"W 210 feet; thence N45°47'38E
75 feet; thence N44°12'22"W 2900 feet; thence N45°47'38"E 150 feet; thence

11.9 aores, more or less, inoluding the right and privilege to grade and
drain the said traot as neoessary; maintain necessary aooess roadways and
walkways; maintain commercial power feeder above or underground; maintain
control cables from approach lighting system substation to Airport Traffic
Control Tower; and maintain a -high voltage power terminal pole on airport
property.
Also, the Lessor, Corpus Christi International Airport, shall clear and
maintain that area within 200.feet of the extended centerline of the NW/SE
Runway from the Northwest end of the Runway pavement Northwest along
extended centerline 3,210 feet free of all obstruotions above the
elevation of the Approach Light and EFAL units for the duration of the .
installation, as shown on Drawing FW -E-4561 dated March 1, 1971, marked
Exhibit "B," attached hereto and made a part hereof.
LOCALIZER: A tract of land on the Corpus Christi International Airport,
Nueces County, Corpus Christi, Texas, Runway 13 and Runway:31 being more
particularly described as follows: Starting on the centerline of the
southeast end of Runway 13-31; thence S44°12'22"E 2540 feet to the Point
of Beginning; thence N45°47'38"E 210 feet to a point; thence S44°12'22"E
400 feet to a point; thence 845°47'38"W 540 feet to a point; thence
N44°12'22"W 400 feet to a point; thence N45°47'38"E 330 feet to the Point
of Beginning; said tract of land containing 5.0 acres, more or less.
Also, the Lessor agrees not to erect or allow to be erected, any structure
or obstruction within a 500 foot radius of the looalizer facility or
within the designated area as shown on Drawing No. SW -B-7544, dated July
10, 1970, marked Exhibit "C," attached hereto and made a part hereof.
GLIDE SLOPE SITE: A tract of land on the Corpus Christi Internationkl
Airport, Nueoes County, Corpus Christi, Texas, Runway 13 and more
particularly described as follows: Starting at a point on the centerline
of the Northwest end of the NW/SE Runway, proceed 1000 feet down the
oenterline of the Runway for a bearing S44°12'22"E; thence S45°47'38"W
385 feet to the Point of Beginning; thence S44°12'22"E 65 feet to a point;
thence S45°47'38"W 65 feet to a point; thence N44°12'22"W 75 feet to a
point; thence N45°47'38"E 65 feet to a point; thence S44°12'22"E 10 feet
to the point of beginning, said plot containing 0.13 acre, more or less,
including the right to maintain the driveway from the site of the runway
to this plot and the right to maintain monitors and cable on the approach
side of the plot as shown on Drawing No. FW -D-4488-3, dated 5-3-60, marked
Exhibit "D," attached hereto and made a part hereof.

MIDDLE MARKER SITE: A treat of land on the Corpus Christi International
Airport, Nueees. County, Corpus Christi, Texas, Runway 13 and more
particularly described as follows: From a point on the centerline of the
Northwest end of the NW/SE Runway proceed N44°12'22"W along the centerline
of the runway extended 3429 Peet to the Point of Beginning; thence
S45°47'38"W 70 feet to a point; thence N44°12'22"W 80 feet to a point;
thence N45°47'38"E 140 feet to a point; thence S44°12'22"E 80 feet to a
point; thence S45°47'38"W 70 feet to the Point of Beginning, said tract
containing 0.25 acre, more or. less, inoluding the right to maintain a
service entrance road to the existing old Shell Pump Road which includes
the right to use and maintain this Shell Pump Road from this point to O.S.
Highway 44, as shown on Drawing FW -D-4488-4, dated 5-3-60, marked Exhibit
"E," attached hereto and made a part hereof including the right to
maintain power and control cables from the terminal building to the
various facilities.
REMOTE TRANSMITTER FACILITY: A tract of land on the Corpus Christi
International Airport, Nueees County, Corpus Christi, Texas, and more
particularly described as follows: From the oenterline point of the
Southeast end of the NW/SE Runway pavement West Southwest approximately
3000 feet to an airport property corner along the North right-of-way line
of Koser Road; thence East along said right-of-way 6 feet to the Point of
Beginning; thence North 300 feet to a point; thence continue North
240 feet; thence East 240 feet; thence South 240 feet; thence West
190 feet; thence South 300 feet to said right-of-way line; thence West
along said right-of-way 50 feet to the Point of Beginning and containing
1.48 acres, more or less, including the right of maintaining overhead
power service from Koser Road to the facility and underground power and
control cable as necessary from the facility to equipment room, Federal
Aviation Administration control quarters as shown on Drawing FW -D-4460-1,
dated 2-17-60, marked Exhibit "F," attached hereto and made a part hereof.
NOW, THEREFORE, effective October 1, 1985, the parties hereto agree to
amend the basic lease by the incorporation of the facilities listed, above.
ALL OTHER TERMS AND CONDITIONS of the basic lease are hereby ratified
and except as amended herein shall be and remain the same.

or resolution, an emergency exists requiring suspension of the Charter rule

or at the present meeting of the City Council.
