HomeMy WebLinkAbout18950 ORD - 07/30/1985TEXAS: • AN ORDINANCE AMENDING CHAPTER 33, OFFENSES AND MISCELLANEOUS PROVISIONS, BY ADDING A NEW SECTION 33-22, LOITERING FOR PROSTITUTION; PROVIDING FOR SEVERANCE; AND PROVIDING FOR P BLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Chapter 33, Offenses and miscellaneous provisions, is hereby amended by adding a new Section 33-22, Loitering for prostitution, to read as follows: Sec. 33-22. Loitering for prostitution. A. It is unlawful for any person to loiter in or near any street or public place in a manner and under circumstances manifesting the purpose of inducing, enticing, soliciting or procuring another to commit an act of prostitution. Among the circumstances which may be considered in determining whether such purpose is manifested are that the person repeatedly beckons to, stops or attempts to stop, or engages male passersby in conversation, or who repeatedly stops or attempts to stop motor vehicle operators by hailing them or gesturing to them. These circumstances do not constitute an exclusive list of factors which the officer may consider. In each case the officer must, from all circumstances present, form a reasonable belief that the crime prohibited herein has been committed before he makes an arrest. No arrests shall be made for a violation of this section unless the arresting officer first affords the suspected person an opportunity to explain his or her conduct, and no one shall be convicted of violating this section if it appears at the trial that the explanation given was true and disclosed a lawful purpose. B. The terms prostitution and public place as used in this section shall have the same meaning as set out in the Texas Penal Code. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3.
