HomeMy WebLinkAbout18978 ORD - 08/13/1985• • AN ORDINANCE AMENDING SECTION 49-21 SO AS TO PROVIDE FOR INTEREST ON OUTSTANDING ASSESSMENTS TO BE COLLECTED, WHICH RATE IS THE GREATER OF (a) EIGHT PERCENT (8%) PER ANNUM OR (b) THE INTEREST RATE PAID BY THE CITY ON ITS MOST RECENTLY ISSUED GENERAL OBLIGATION BONDS; AND DECLARING AN EMERGENCY. WHEREAS, the Texas Legislature amended Article 1105(b) of the Revised Civil Statutes of Texas to authorize cities to charge on outstanding paving assessments an interest rate which is the greater of eight percent per year or the rate payable by the city on its most recently issued general obligation bonds; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 49-21, Required improvements; policy on assessments, of Article II, Street, Sidewalk, Curb and Gutter and Driveway Construction, of the City Code of Ordinances is hereby amended to hereafter read as follows: 04P.016.01 "D. Payment of Assessment - The cost assessed against abutting property shall be payable in monthly installments not to exceed one hundred twenty (120) in number, the first of which shall be payable within thirty (30) days from the date of completion of said improvements and their acceptance by the City of Corpus Christi, and one installment each month thereafter until paid, together with interest thereon, which rate shall be the greater of (a) eight percent (8%) per annum or (b) the interest rate paid by the City on its most recently issued general obligation bonds, with the provision that any of said installments may be paid at any time before maturity by the payment of the principal and accrued interest thereon. Any property owner against whom and against whose property an assessment has been levied may pay the whole assessment chargeable to him without interest within thirty (30) days after the acceptance and completion of said improvements. For assessment payment and interest information on qualifying low income residentially used properties in community development block grant projects, refer to subsection (C.II) herein." 18978 MICROFILMED • SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to adopt the aforementioned interest rate policy on paving assessments at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 13th day of August, 1985.
