AN ORDINANCE
AMENDING THE CODE OF ORDINANCES, CHAPTER 13, ARTICLE
II, DIVISION 2, JUNKED VEHICLES, SECTION 13-38 TO
DEFINE A JUNKED VEHICLE AS A MOTOR VEHICLE THAT IS
INOPERATIVE, AND THAT DOES NOT HAVE AFFIXED TO IT
EITHER AN UNEXPIRED LICENSE PLATE OR A VALID VEHICLE
INSPECTION CERTIFICATE, THAT IS WRECKED, DISMANTLED,
PARTIALLY DISMANTLED, OR DISCARDED, OR THAT REMAINS
INOPERABLE FOR A CONTINUOUS PERIOD OF MORE THAN 45
DAYS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
PUBLICATION.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Section 13-38(a) of Chapter 13, Article II,
Division 2, JUNKED VEHICLES, be amended to read as follows:
"(a) Junked vehicle means a motor vehicle as defined in
Section 1, Chapter 42, General Laws, Acts of the 41st
Legislature Second Called Session, 1929 (Article
6701d-11, Vernon's Texas Civil Statutes):
(1) that is inoperative; and
(2) that does not have lawfully affixed to it either
an unexpired license plate or a valid motor
vehicle safety inspection certificate, that is
wrecked, dismantled, partially dismantled, or
discarded, or that remains inoperable for a
continuous period of more than 45 days."
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance shall be
held invalid or unconstitutional by final judgment of a court of competent
Jurisdiction, it shall not affect any other section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance for it is
the definite intent of this City Council that every section, paragraph,
subdivision, clause, phrase, word or provision hereof be given full force
and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating
in substance the purpose of the ordinance, this ordinance to become
effective upon such publication.
