CLOSING AND ABANDONING APPROXIMATELY 100 FEET OF NEMEC
STREET AT THE HAMLETT DRIVE INTERSECTION, AND A 350 FOOT
LONG PORTION OF UNOPENED 30 FOOT WIDE HAMLETT DRIVE, FROM
NEMEC STREET TO SOUTH PADRE ISLAND DRIVE, SUBJECT TO
PROVISIONS LISTED BELOW.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of approximately 100 feet of Nemec Street at the Hamlett Drive
Intersection, and a 350 foot long portion of unopened 30 foot wide Hamlett Drive
from Nemec Street to South Padre Island Drive, was given by publication and
mailed to the last known addresses of the owners of property abutting the public
way and within 450 feet of the area proposed to be closed, and thereafter,
pursuant to said notice, public hearing was held at Regular Council Meeting by
the City Council of the City of Corpus Christi on August 6, 1985, in accordance
with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will they be within the foreseeable future needed as public rights-of-way,
and that the same should revert to the abutting property owners, subject to
certain specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned, subject to the
conditions stated herein, approximately 100 feet of Nemec Street at the Hamlett
Drive intersection, shown by plat of Botsford Place Unit 2, recorded in
Volume 16, Page 47, Map Records, Nueces County, Texas, and a 350 foot long
portion of unopened 30 foot wide Hamlett Drive, from Nemec Street to South Padre
Island Drive, shown by plat of Nemec Subdivision recorded in Volume 12, Page 38,
Map Records, Nueces County, Texas; returning said portion of Hamlett Drive to
adjacent Lots 1 and 36, Block 3, Nemec Subdivision, and retaining the western
1/2 (15 feet wide) as a utility easement. The portion of Nemec Street shall be,
and is hereby divided and utility easements retained as shown on attached
Exhibit "A". Provided, further that all lots affected hereby shall be replatted
at their owners' expense.
