A RESOLUTION
SUPPORTING THE CONCEPT OF ESTABLISHING FAMILY HOME SETTINGS
FOR DISABLED PERSONS WITHIN THE COMMUNITY, BUT URGING THE
NUECES COUNTY COMMISSIONERS COURT TO EXPLORE ALL ALTERNATE
METHODS AVAILABLE TO MH -MR WHICH WOULD INCREASE COMMUNITY
ACCEPTANCE OF SUCH FACILITIES; AND DECLARING AN EMERGENCY.
WHEREAS, the Texas Legislature has recently enacted Senate Bill 940,
entitled the Community Homes for Disabled Persons Location Act, to include
operation of a family home for not more than six disabled persons among the
permitted uses in all residential zoning districts in the state; and
WHEREAS, the City Council supports the concept of establishing family
homes for the disabled within the community; and
WHEREAS, the City Council also supports establishing such facilities
in areas where both the disabled participants will be beneficially affected by
such environment and the neighborhoods will not suffer significant detrimental
effects; and
WHEREAS, any such program needs to develop specific criteria and a
procedure to be used to evaluate and select sites for the location of such
facilities to assure positive results; and
WHEREAS, the Nueces County Commissioners Court is presently
considering whether to approve a project proposed by MH -MR for the acquisition
of various houses within the City to be used as family home facilities;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. The City Council supports the concept of establishing
family home settings for the disabled within the community. However, the City
Council hereby expresses its opposition to the amendment of the zoning
ordinances of cities by state statute, thus denying cities an exercise of their
right to local self government.
SECTION 2. The City Council strongly urges the Nueces County
Commissioners Court to explore all alternate sites and methods of meeting the
objective of establishing family home settings to obtain maximum community
acceptance of such facilities.
SECTION 3. The City Council strongly urges MH -MR to develop specific
criteria and a procedure to evaluate and acquire sites for the location of such
facilities within residential neighborhoods to assure that both the disabled

participants will be beneficially affected by the neighborhood environment and
the neighborhoods will not experience significant detrimental effects.
SECTION 4. The criteria for evaluating and selecting such family home
sites should include at least the following:
a. the site selected will have a beneficial and motivating effect
upon disabled participants; and
b. the site selected will not have a significant detrimental effect
upon the health, safety, or welfare of persons residing in the
neighboring dwelling units and will not substantially affect the
character or property values of such neighborhood, based upon
accepted planning and zoning principles.
SECTION 5. The procedure for evaluating and selecting such facility
sites should include at least the following:
a. coordination of such site evaluation and selection with municipal
planning and zoning agencies to assure the above criteria and
legal minimum spacing requirements are met;
b. holding meetings in neighborhoods prior to site selection;
c. initially establishing facilities on sites selected on an interim
basis only;
d. periodically evaluating in a neighborhood meeting context each
site selected to determine whether, in fact, the above criteria
continue to be met.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the immediate
need for the efficient and effective administration of City affairs, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the 27th day of August, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
