BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION: AND ORDAINING OTHER MATTERS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the publication of Notice of Intention to Issue Certificates of Obligation to provide proceeds for the construction of necessary and urgently needed public improvements is required as soon as possible and without delay; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Ann. Civ. St. art. 6252-17, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That attached hereto and marked "Exhibit A" is a form of notice, the form and substance of which are hereby passed and approved. SECTION 2. That the City Manager shall cause said notice to be published, in substantially the form attached hereto, in the "Corpus Christi Caller (Times)", a newspaper of general circulation in the City of Corpus Christi, Texas, for two consecutive weeks, the date of the first publication to be at least fourteen days prior to the day tentatively proposed for authorizing the issuance of the Certificates of Obligation as shown in said notice. SECTION 3. The fact that the contemplated construction of public improvements is necessary for the orderly development and growth of the City of Corpus Christi, Texas, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared in writing that such public emergency and imperative necessity exist, and having requested that said Charter Rule be suspended and that this ordinance take effect and be in full force and effect from and after its passage, it is accordingly so ordained. SECTION 4. That all ordinances and resolutions or parts thereof in conflict herewith are hereby repealed. PASSED AND APPROVED this the 10th day of September, 1985. Martin, J. Bruce Aycock, Juan Garza, Armando Chapa, with the following absent: Mayor, Mayor Pro -Tem, Councilmembers, City Manager, City Attorney, Director of Finance, City Secretary, i(,/wD A STRONG constituting a quorum, at which time the following among other business was transacted: C/Tr M&/t, Maar/A/presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council a communica- tion in writing pertaining to said proposed ordinance, as follows: "Corpus Christi, Texas September 10, 1985 "TO THE CITY COUNCIL Corpus Christi, Texas Gentlemen: "The public importance and pressing need for the issuance of certificates of obligation to facilitate further financing for permanent improvements creates an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring ordinances to be considered and voted upon at three regular meetings. I, therefore, request that the City Council pass the proposed ordinance authorizing the issuance of certificates of obligation as an emergency measure. You will please consider this request in connection with the ordinance which is to be introduced for passage by the City Council on the subject. The motion was seconded by Councilmember ASE RA./PN G A . The motion was carried by an unanimous vote by the City Council, viz.: AYES: All present voted Aye. NAYS: None. Councilmember /%E/1/ DE Z moved that the ordi- nance be passed finally. The motion was seconded by Coun- cilmember BER 4LO N OOP. The motion was carried by the following vote: AYES: A11 present voted Aye. NAYS: None. The Mayor announced that the ordinance had been passed. The ordinance is as follows: • EXHIBIT A NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION NOTICE IS HEREBY GIVEN that it is the intention of the City Council of the City of Corpus Christi, Texas, to issue the interest bearing certificates of obligation of the City entitled "City of Corpus Christi, Texas Tax and Revenue Certificates of Obligation, Series 1985", for the purpose of paying contractual obligations to be incurred by the City. The City Council tentatively proposes to authorize the issuance of said Certificates of Obligation at its regular meeting place in the City Hall at a meeting to commence at 2 o'clock, P.M., on the 1st day of October, 1985. The maximum amount of Certificates of Obligation indebtedness that may be authorized for such purpose is $1,300,000. The City Council presently proposes to provide for payment of such Certificates of Obligation from the levy of taxes and from revenues.
