HomeMy WebLinkAbout19021 ORD - 09/17/1985• AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 SETTING FORTH ZONING CLASSIFICATION OF SAID AREA OF LAND DESCRIBED AS A PORTION OUT OF LOT 9, SECTION 5, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of James R. Howze, for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, September 17, 1985, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and that permanent zoning of "B-1" Neighborhood Business District, more fully described hereinafter, be granted; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That Article 31 of the Zoning Ordinance is hereby amended by adding to Section 31-5 setting forth a zoning classification of "B-1" Neighborhood Business District on a portion of land out of Lot 9, Section 5, Flour Bluff and Encinal Farm and Garden Tracts, further described by metes and 04P.104.01 19021 MICROFILMED • • bounds below, such zoning classification of the hereinafter described property to be effective upon annexation: FIELDNOTES for a 6.28 acre tract of land out of Lot 9, Section 5, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41-43 Map Records of Nueces County, Texas: BEGINNING at a point an the Southeast boundary line of South Staples Street (80.00 feet wide) for the East corner of this tract from which corner a 5/8 inch iron rod set for the South corner of Lot 1, Block 2, Crossgate Annex a map of which is recorded in Volume 51, Pages 35-36 Map Records of Nueces County, Texas, bears North 61°01'42" West 10.00 feet; THENCE South 28°55'00" West with said Southeast line, 440.30 feet to a point on the centerline of Timbergate Drive (40.00 feet wide) for the South corner of this tract; THENCE North 61°00'45" West with said centerline, 622.21 feet for the West corner of this tract; THENCE North 29°01'00" East leaving said centerline at 30.00 feet pass a 5/8 inch iron rod set for the South corner of Lot 36, Block 101, Hunter's Point Unit 2, a map of which is recorded in Volume 49, Pages 16-17, Map Records of Nueces County, Texas, with the Southeast subdivision line of said Hunter's Point in all a distance of 440.12 feet to a 5/8 inch iron rod set for the West corner of said Lot 1, Block 2, and the North corner of this tract; THENCE, South 61°01'42" East with the Southwest boundary line of said Lot 1, Block 2, a distance of 621.44 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved of the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or 04P.104.01 • resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 17th day of September, 1985.
