AMENDING ORDINANCE NO. 3658 AND NO. 8217 OF THE COMPENSATION
AND CLASSIFICATION PLAN TO COMPLY WITH THE FAIR LABOR
STANDARDS ACT; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Ordinance No. 3658 and Ordinance No. 8127 of the
Compensation and Classification Plan be amended by deleting the following
sections and subsections: 250.2, 250.3, 250.4, 507, 512, 513, 514, 701, 703,
703.1, 703.2, 703.3, 750, 801, 802, 803, 804, 805, 900.3, and 900.4.
SECTION 2. That Ordinance No. 8127 be amended by amending Section 501
by retaining the heading "501 Salary Schedules" and deleting the existing
paragraph in full.
SECTION 3. That Ordinance No. 8127 be amended by changing the
subsection number only for Wage Rate on Construction Work from 511 to 710.
SECTION 4. That Ordinance No. 8127 be amended by amending Section 708.1,
Lump -Sum Productivity/Merit Payment, adding the following paragraph:
708.1 Productivity, Safety, or Incentive Programs
The City Manager may authorize the implementation of
productivity, safety, or incentive programs and approve the
departmental procedures established for the implementation
of these programs where these have been evaluated by the
Director of Personnel and Labor Relations for a
determination of the effects of the Fair Labor Standards Act
on the program.
SECTION 5. That Ordinance No. 8127 be amended by amending Section 550,
Administration of the Compensation Plan, by adding the following paragraph under
the existing heading:
The City Manager is instructed to establish fair and
equitable compensation and classification plan
administrative procedures consistent with the Fair Labor
Standards Act of 1938 as amended. Procedures shall not
apply to Police and Fire personnel who are covered under
collective bargaining contracts.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the immediate

need for the efficient and effective administration of City affairs by amending
the Compensation and Classification Plan as aforementioned, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the 15th day of October, 1985.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
