SUPPORTING THE POSITION OF THE GOVERNOR OF TEXAS
CONCERNING "DRAFT REPORT TO CONGRESS ON THE COASTAL
BARRIER RESOURCES SYSTEM AS REQUIRED BY SECTION 10 OF
PL 97-348; THE COASTAL BARRIER RESOURCES ACT OF 1982".
WHEREAS, the U.S. Congress enacted the Coastal Barrier Resources
Act in 1982 establishing the Coastal Barrier Resources System comprised of
units of undeveloped Coastal Barriers within which most federal
expenditures to promote growth or development are no longer available; and
WHEREAS, the U.S. Department of Interior has prepared a "Draft
Report to Congress on the Coastal Barrier Resources System as required by
Section 10 of PL 97-348; the Coastal Barrier Resources Act of 1982" which
identifies conservation alternatives to be considered for recommendation to
Congress; and
WHEREAS, the draft report proposes expansion of the Coastal
Barrier Resources System to add land within municipalities in Texas where
development is already adequately controlled by local government; and
WHEREAS, the draft report further proposes to expand the system
to include lands owned by the State of Texas and local governments
including State and local park land; and
WHEREAS, the Governor of Texas has requested the Secretary of the
Interior to modify the report as follows:
To delete the inclusion of State and local lands as new units to the
system.
To correct errors in delineation and inconsistent application of
definitions in specific proposed new units and additions to existing
units in Texas, and to provide extensive consultation to the affected
governmental bodies and private owners before any additions are
advanced for consideration.
To ensure that lands presently located within city limits should not
be reclassified as undeveloped coastal barriers since these lands are
already being managed under local ordinance in accordance with, and
subject to, state laws.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Council urges the delegates of the 72nd
Annual Conference of the Texas Municipal League to adopt a resolution, a
copy of which is attached hereto as Exhibit "A".
SECTION 2. That upon written request of the Mayor or five
Council members, copy attached, to find and declare an emergency due to the

immediate need for the efficient and effective administration of City
affairs, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this resolution
is passed and shall take effect upon first reading as an emergency measure
this the 15th day of October, 1985.

72nd Annual Conference of the Texas Municipal League that TML supports the
position of the Governor of Texas concerning "Draft Report to Congress on
the Coastal Barrier Resources System as required by Section 10 of
PL 97-348; the Coastal Barrier Resources Act of 1982".
PASSED AND APPROVED at San Antonio, Texas this 2nd day of
November, 1985.

(1) Statement of the Problem Addressed by this Resolution:
Land use and development regulation are handled best at the local
level by local governing bodies exercising their authority consistent
with law and the public interest. The draft report to Congress would
have the Federal government dictate the use of lands within and
adjoining coastal cities.
(2) How Would Implementation of this Resolution Solve the Problem?
Implementation of the resolution would preserve and foster local
self-government by resisting the proposed federal intrusion.

or resolution, an emergency exists requiring suspension of the Charter rule

and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
