HomeMy WebLinkAbout19060 RES - 10/15/1985A RESOLUTION URGING THE GOVERNOR TO FORM A TASK FORCE TO STUDY THE POTENTIAL EXPOSURE OF LOCAL GOVERNMENTS TO LIABILITY LOSSES AND THE AVAILABILITY OF ADEQUATE INSURANCE COVERAGE ALTERNATIVES. WHEREAS, local governments in the State of Texas are faced with a crisis of non-availability or under -availability of adequate insurance coverage to protect themselves against all forms of liability exposure; and WHEREAS, claims against local governments have increased to staggering proportions and jury verdicts have skyrocketed; and WHEREAS, insurance companies no longer consider local governments acceptable underwriting risks and have denied coverage to local govern- ments; and WHEREAS, the unavailability of adequate insurance coverage places units of local government in catastrophic financial jeopardy forcing local governments to refuse to undertake the essential public services; and WHEREAS, such potential liability exposure also affects individual officers and employees of local governments, discouraging them from effectively carrying out their public duties and risking catastrophic personal financial loss; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Council urges the delegates of the 72nd Annual Conference of the Texas Municipal League to adopt a resolution, a copy of which is attached hereto as Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the immediate need for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this the 15th day of October, 1985. APPROVED: President ATTEST: Executive Director 04P.159.01 • • (1) Statement of the problem addressed by this Resolution: The potential liability of units of local government and the staggering amount of claims and jury verdicts have caused the availability of insurance coverage to be almost non-existent to units of local government. (2) How would implementation of this Resolution solve the problem?: Implementation of this Resolution would focus attention on this crisis, determine its cause and scope, and study alternatives. Alternatives could result in stabilizing the financial integrity of units of local government throughout Texas and enable them to continue to provide essential public services without suffering financial disaster. 04P.159.01 Corpus Christi, Texas ` day of 1985 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
