WRIGHT, ARCHITECT, A JOINT VENTURE, TO PERFORM A RESTORATION AND EVALUATION STUDY OF THE BLUFF BALUSTRADE FACILITIES ALONG THE UPPER/LOWER BROADWAY STREET SYSTEM FROM NEAR TAYLOR STREET TO PARK AVENUE; APPROPRIATING $23,300; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement for consultant services with Govind and Associates and John R. Wright, Architect, a Joint Venture, to perform a restoration and evaluation study of the Bluff Balustrade facilities along the Upper/Lower Broadway Street system from near Taylor Street to Park Avenue all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $23,300 from the Reinvestment Zone No. 1 of which $19,600 is for the agreement and $3,700 is for testing and printing costs. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 22nd day of October, 1985. Wright, Architect, a Joint Venture, hereinafter called "Consultant". WITNESSETH: WHEREAS, the Bluff Balustrade facilities along the Upper/Lower Broadway Street system in the City are in need of repair; and WHEREAS, the City desires to restore these facilities as much as possible to their original state; and WHEREAS, the City is interested in improving adjacent public facilities existing along the Balustrade structure; and WHEREAS, the City desires the services of a consultant to evaluate such restoration methods, repairs, improvements, and other construction necessary to achieve the restoration goal; NOW, THEREFORE, the City and Consultant agree as follows: Consultant agrees to perform, at his own expense, a restoration and evaluation study of the Bluff Balustrade facilities along Upper/Lower Broadway from near Taylor Street to Coopers Alley and including a Bluff improvement study along the east side of Upper Broadway from the Midtown Traffic Exchange to Park Avenue. Consultant also agrees to develop conceptual plans for other City -owned property adjacent to the Bluff Balustrade. I. SCOPE OF SERVICES A. Consultant will evaluate the present condition of the retaining wall, steps, the tunnel originally constructed with the Balustrade facilities, abutting streets and sidewalks, pertinent retaining walls, and other amenities constructed in the Upper/Lower Broadway system. B. Consultant will evaluate methods of restoration and/or replace- _ went of portions of the Balustrade facilities and adjacent improvements outlined in Item A above, including the Confederate Memorial Sculpture at Peoples Street. C. Consultant will research and identify any problems and/or costs involved in restoring the original lighting system along the Balustrade facilities. Consultant will evaluate any other identifiable slope improve- ments which might improve the Bluff system from near Taylor Street to Park Avenue. E. Consultant will review and evaluate any City staff suggested concepts for constructing steps along various portions of the Bluff. F. Consultant will prepare cost estimates showing costs of all elements of work outlined herein in such detail as is deemed necessary by the City. G. Consultant will furnish twenty-five (25) copies of a completed report of the Balustrade Restoration Study. City will pay the cost of printing the final report. II. CITY FURNISHED ITEMS The City will furnish Consultant with original construction plans of the Balustrade facilities as are available in City files and any other plans relating to the Bluff facilities as are available and necessary and will pay the cost of any soils investigation necessary as part of this work. III. COMPLETION SCHEDULE OF SERVICES Time is of the essence in the completion of this work. Accordingly, Consultant agrees to furnish to the City Engineer, in draft form, three (3) copies of a preliminary report on the Balustrade Restoration Study within forty-five (45) calendar days of authorization to proceed under this Agreement. Consultant also agrees to furnish the required twenty-five (25) copies of a completed restoration study, after draft review by the City, within twenty-five (25) calendar days of notice of approval of the draft study. IV. OWNERSHIP OF DOCUMENTS Consultant agrees that all drawings, exhibits, reports, or documents prepared by him shall become the sole property of the City upon completion of the work described herein. Final payment of fees by the City will not be made until these materials have been delivered to the City. Consultant will be permitted to retain duplicate copies of such materials but may not reproduce these materials without approval of the City. V. FEES City agrees to pay Consultant a fee of Nineteen Thousand Six Hundred Dollars ($19,600.00) for services under this Agreement. Said fee is a fixed fee and will be paid proportionately to the Consultant as follows: Sixty percent (60%) of said $19,600 will be paid Consultant upon submission of the draft report indicated herein. The remaining forty percent (40%) of said $19,600 will be paid Consultant within two (2) weeks of delivery of the twenty-five (25) completed copies of the Balustrade Restoration Study.
