HomeMy WebLinkAbout19069 ORD - 10/22/1985TEXAS: M AN ORDINANCE AMENDING CHAPTER 49 OF THE CITY CODE BY ADDING A NEW ARTICLE VI, SECTION 49-90, A STATEMENT OF POLICY FOR CONVERSION OF NEIGHBORHOOD STREET LIGHTS; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Chapter 49 of the City Code is hereby amended by adding a new Article VI, Section 49-90, A Statement of Policy for Conversion of Neighborhood Street Lights to read as follows: "Article VI, Section 49-90 A Statement of Policy for Conversion of Neighborhood Street Lights The City may allow deviation from standard neighbor- hood street lights and will convert lights to a brighter intensity, provided the following conditions are met: (1) The minimum number of conversions shall be limited to a residential area having no less than twenty (20) lights. (2) The maximum light size shall be 16,000 lumen. (3) A legal entity with capacity to contract, such as a neighborhood organization, shall enter into an agreement with the City, shall be responsible for conversion costs, annual advance payment for the rate cost differential, and shall assign to the City a certificate of Deposit to cover the costs of any future conversions." SECTION 2. If for any reason any section, paragraph, subdivi- sion, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivi- sion, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such publication. 04P.171.01 isms MICROFILMED SECTION 4. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs by amending the City Code as aforementioned, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 22nd day of October, 1985.
