AN ORDINANCE
AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE
ACQUISITION OF PARCEL 2 IN CONNECTION WITH THE McARDLE ROAD
STREET IMPROVEMENTS PROJECT 220-82-3; APPROPRIATING $38,940;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be authorized to execute the
documents necessary for the acquisition of Parcel 2 in connection with the
McArdle Road Street Improvements, Project 220-82-3, a substantial copy of which
is attached hereto and made a part hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $38,940 out of the
Street Bond Fund.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to take
immediate action to preserve and protect public property by expediting the
purchase of land necessary for the abovementioned McArdle Road Street
Improvements Project, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this the
12th day of November, 1985.

COUNTY OF NUECES I
THAT Corpus Christi Theatres, Inc.,
of the County of Nueces, State of Texas, for and in considera-
tion of the sum of Thirty -Eight Thousand Nine hundred forty
Dollate and no cents ($38,940.00)
to it in hand paid by the City of Corpus Christi, Nueces
County, Texas, and other good -and valuable considerations, the
receipt of which is hereby acknowledged, have granted end con-
veyed and by these presents do grant and convey unto the City
of Corpus Christi, Nuecee County, Texas, a municipal corpora-
tion duly incorporated under and by virtue of the laws of the
State of Texas, its successors and legal representatives, the
free and uninterrupted use, liberty, privilege, and easement
of going in, on, over, under and along a certain tract of land
situated In Nueces County, Texas, and being described as
follows:
Being a tract of land out of Lots 7 and 8, Section 13,
Flour Bluff and Encinal Farm and Garden Tracts as
shown by map of record in Volume A, Pages 41, 42, 43,
Map Records, Nueces County, Texas, and more parti-
cularly described by metes end bounds as follows:
Beginning at the north corner of Lot 7;
Thence S. 29° 00' W., along the westerly line of Lot
7, a distance of 20.0 feet to the point of beginning
of the tract of land herein described;
Thence S. 61° 00' E.,•along a line that is 20.0 feet
south of and parallel to the northerly lines of Lots
7 and 8, a distance of 990.0 feet to a point;
Thence S. 290 00' W., a distance of 10.0 feet to a
point, said point being the north corner of Lot 1,
Woodlawn Unit I as shown by map of record in Vol.
19, Page 91, Map Records, Nueces County, Texas;
Thence N. 61° 00' W., along a line that is 30.0
feet south of and parallel to the northerly linea of
Lots 7 end 8, a distance of 990.0 feet to a point on
the westerly line of Lot 7;
Thence N. 29° 00' E., along the westerly line of Lot
7, a distance of 10.0 feet to the point of beginning
and containing 0.227 acres, more or less.

A map of which is marked "Exhibit A. and attached hereto
and made a part hereof for all purposes.
Together with the free ingress, egress, and regress to and
for the City of Corpus Christi, for the purpose of constructing
streets, sidewalks, curbs, gutters and appurtenances upon said
tract and way for the public use by foot, with automobiles,
carte, carriages, and all other vehicles and all other means of
transportation necessary or convenient at all times and in all
eeasone in, along, and upon said tract and way, as well as for
laying, repairing, servicing, and maintaining of public utility
lines and storm sewers in, on, over, under, and along said
tract or way.
TO HAVE AND TO HOLD, all and singular, the rights and
privileges aforesaid to the City of Corpus Christi, Texas, its
successors and legal representatives and the public, for the
proper use as public streets and utility easements or utility
easements for so long as used for each purposes or any of them,
and if the use for said tract and way for all of said uses be
ever abandoned, then in that event, the aforesaid rights and
privileges shall cease, and all rights herein granted shall
revert to the Grantor herein, his heirs or assigns.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
