HomeMy WebLinkAbout19095 ORD - 11/19/1985AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF OAKHURST PLAZA, INC. BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOT 2, BYRON WILLIS SUBDIVISION FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Oakhurst Plaza, Inc. for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, November 19, 1985, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a portion of Lot 2, Byron Willis Subdivision, further described by metes and bounds below, in the City of Corpus Christi, Nueces County, Texas, be changed from "I-2" Light Industrial District to "B-4" General Business District: 04P.220.01 FIELDNOTES for 6.84 acres of land (not based on an on the ground survey) out of Lot 2, Byron Willis Subdivision, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of South Padre Island Drive (State Highway 358) for the North corner of this tract, from which corner the East corner of Lot 7, Block C, Byron Willis Subdivision, a map of which is recorded in Volume 30, Page 69, of said Map Records bears North 61°41'00" West 220.00 feet; THENCE South 61°41'00" East, along said Southwest boundary line of South Padre Island Drive, 100.00 feet to a corner of this tract; 190995 MICROFIl iiED • 04P.220.01 THENCE, leaving said Southwest boundary line, South 28°19'00" West 195.00 feet to the point of curvature of a circular curve to the right which has a central angle of 23°25'22", a radius of 617.88 feet, a tangent distance of 128.08 feet and an arc length of 252.59 feet; THENCE, with said curve to the right, 252.59 feet to a point of tangency; THENCE, South 51°44'22" West, 184.90 feet to the point of curvature of a circular curve to the left which has a central angle of 10°06'50", a radius of 448.36 feet, a tangent distance of 39.68 feet and an arc length of 79.14 feet; THENCE, with said curve to the left, 79.14 feet to an inside corner of this tract; THENCE, South 61°00'00" East 76.16 feet to a corner of this tract; THENCE, South 15°06'59" East 43.41 feet to a corner of this tract; THENCE, South 61°02'00" East 110.00 feet to a corner of this tract; THENCE, South 28°58'00" West 112.00 feet to an inside corner of this tract; THENCE, South 61°02'00" East 180.00 feet to the East corner of this tract; THENCE, South 28°58'00" West 340.00 feet to a point on the Northeast boundary line of a 70.00 foot wide drainage easement for the South corner of this tract; THENCE, North 61°02'00" West, along the Northeast boundary of said drainage easement, 575.56 feet to the South corner of Lot 4, Block A, Kibby Industrial Subdivision, a map of which is recorded in Volume 45, Page 217 of said Map Records and the West corner of this tract; THENCE, North 29°00'00" East, along the Southeast boundary line of Lot 4, Block A, 385.00 feet to a corner of this tract; THENCE, leaving said Southeast line of Lot 4, Block A, South 61°00'00" East 80.00 feet to an inside corner of this tract; THENCE, north 29°00'00" East 98.00 feet to a corner of this tract; THENCE, South 61°02'00" East 19.20 feet to an inside corner of this tract and the point of curvature of a circular curve to the right whose radius point bears South 50°16'11" East 526.36 feet and which has a central angle of 12°00'33", a radius of 526.36 feet, a tangent distance of 55.36 feet and an arc length of 110.32 feet; THENCE, with said curve to the right, 110.32 feet to the point of tangency; THENCE, North 51°44'22" East 184.90 feet to the point of curvature of a circular curve to the left which has a central angle of 23°25'22", a radius of 539.88 feet, a tangent distance of 111.92 feet and an arc length of 220.70 feet; THENCE, with said curve to the left, 220.70 feet to the point of tangency and the point of curvature of another circular curve to the left whose radius point bears North 61°41'00" West 437.53 feet and which has a central angle of 12°42'55", a radius of 437.53 feet, a tangent distance of 48.75 feet and an arc length of 97.10 feet; THENCE, with said curve to the left, 97.10 feet to the point of tangency; THENCE, North 15°36'05" East 2.45 feet to the point of curvature of a circular curve to the right which has a central angle of 12'42'55", a radius of 437.53 feet, a tangent distance of 48.75 feet and an arc length of 97.10 feet; THENCE, with said circular curve to the right, 97.10 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for 04P.220.01 • • efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 19th day of November, 1985.
