HomeMy WebLinkAbout19097 ORD - 11/26/1985• AN ORDINANCE AMENDING CHAPTER 17, FINANCE AND TAXATION, ARTICLE 1, IN GENERAL, BY ADDING SEC. 17-4.2 TO PROVIDE FOR SALE OF SURPLUS PROPERTY TO OTHER GOVERNNMENTAL ENTITIES; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Article I, In General of Chapter 17, Finance and Taxation, is hereby amended by adding a new section to read as follows: Sec. 17-4.2. Sale of City property -sale of surplus property to governmental entities. Upon the determination by the City Manager that personal property belonging to the City cannot be used in any department in the City pursuant to Section 17-4, such personal property may be conveyed to any other governmental entity for further public use. Any sale of personal property made under this section shall never be for less than the fair value of the City's interest in such property. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, Word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written reqeust of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient and effective administration of City affairs by amending the City Code as aforementioned, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency this the 26th day of November, 1965.
