BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Code be amended by repealing Sections 49-40,
49-41, 49-42, 49-43, and 49-44, and by amending Division 3 entitled "Driveway
Design and Construction Standards," as more fully set forth in the Manual of
Driveway Design and Construction Standards, a copy of which, authenticated by
the signatures of the Mayor and the City Secretary and made a public record by
this ordinance of the City Council, on file in the office of the City Secretary,
is hereby adopted as the Manual of Driveway Design and Construction Standards of
the City of Corpus Christi, as fully as if copied at length in this ordinance.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.

MANUAL OF DRIVEWAY
DESIGN AND CONSTRUCTION
STANDARDS
I. INTRODUCTION
The purpose and intent of this article is to provide minimum standards,
and requirements for safe and convenient access to abutting private
property along roadways, and to provide for suitable geometric layout,
materials and methods of construction for driveway approaches which
are placed or changed in use. The objective of driveway access control
is to assure that access is provided to abutting private property with
a minimum of interference with the free and safe movement of vehicular
and pedestrian trafic, and to minimize traffic congestion arising from
vehicular entry to or exit from abutting private property.
II. STREET IMPROVEMENTS AND EXISTING DRIVEWAYS
Where the City of Corpus Christi removes or authorizes the removal
of the curb and gutter and concrete driveway approaches, or driveway
approaches with pipe culverts, for street improvements such as widening
or paving or upgrade of drainage, the City will replace the existing
concrete driveway approaches at the same location when such approaches
aer in use and are providing access to a developed site at the time
of construction of such roadway improvements. Provided however, the
Director of Transportation or his designee, shall have the sole
authority, based on a review of the foregoing criteria, to determine
whether an existing driveway approach shall be reconstructed or whether
a new driveway approach shall be constructed.
III. DEFINITIONS
For the purpose of construing and enforcing this article certain words,
terms, phrases shall be defined as follows:
Commercial Driveway Approach: One providing access to an office,
retail or institutional building or to an apartment building having
three or more dwelling units. Such buildings are customarily
serviced by trucks or an incidental rather than a prinicpal driveway
use. Industrial plant driveways whose principal function is to
serve administrative or employee parking lots are considered
commercial driveways.
Contractor: Any person, association or corporation engaged in
the business of installing or altering walks, driveway approaches,
curbs, gutters or pavements or appurtenances on public property.
This term shall also include those who represent themselves to
be engaged in the business whether or not actually doing the work.

Curb: A vertical or sloping structure located along the edge
of the roadway, normally constructed integrally with the gutter,
which strengthens and protects the pavement edge and clearly defines
the pavement edge to vehicle operators.
Curb Return Radii: The curvature or corner radius that facilitates
vehicular turning movements between the driveway and the edge
of the roadway pavement.
Driveway Approach: A facility between the edge of the roadway
and the property line intended to provide vehicular access from
the roadway to private property.
Frontage: Frontage of a lot means the distance between the property
lines for a given log bordering along a single roadway.
Gutter: A generally shallow waterway adjacent to a curb used
or suitable for drainage of water.
Industrial Driveway Approach: One directly serving substantial
numbers of truck movements to and from an industrial facility,
warehouse or truck terminal. A regional shopping center may have
one or more driveways specially designed, signed and located to
provide access for large trucks. These are classified as Industrial
driveways.
Intersection: The common area embraced between the projected
lines of the right of way of two or more roadways which join at
any angle whether or not one such roadway crosses the other.
Lot: An undivided tract or parcel of land which is, or in the
future may be, offered for sale, conveyance, transfer, or
improvement, which is designated as a distinct and separate tract
or parcel, and which is or will be identified by a number or symbol
on a plat which has or may be filed for record.
Sidewalk: That portion of the roadway primarily constructed for
the use of pedestrians and constructed of concrete or other durable
materials.
Residential Driveway Approach: One providing access to one or
two family dwelling units.
Right of Way: The entirety of any public roadway area; a strip
of land including the public roadway and adjacent pedestrian ways.

IV. AUTHORITY OF THE DIRECTOR OF TRANSPORTATION
(a) The Director of Transportation shall be responsible for the
administration and enforcement of the provisions contained
in the Manual of Driveway Design and Construction Standards
and may delegate said authority to designated
representative(s).
(b) The Director of Transportation shall review and approve all
proposed driveway approaches on public right of way within
the City of Corpus Christi with the exception of proposed
driveway approaches included in the new construction of one
or two family dwelling units.
(c) The Director of Transportation shall review and approve the
site layout of commercial retail, office, and industrial
developments for the purpose of minimizing traffic congestion
arising from vehicular entry to or exit from the proposed
site development and such review shall be limited to the
following items:
(1) The location of the centerline of the driveway approach
shall be aligned with the centerline of parking aisle
so that vehicular conflict between exiting and entering
vehicles at a driveway approach is minimized.
(2) A minimum driveway throat length of twenty (20') feet
measured from the right of way line and parallel to
the driveway approach shall be required for all driveway
approaches on roadways classified as arterials by the
Corpus Christi Urban Transportation Plan that provide
access to commercial developments with more than 99,999
square feet of gross leasable area after the requirements
of Article 22: Parking Regulations and Article 23:
Off -Street Loading Regulations of the Corpus Christi
Zoning Ordinance are met.
(3) Drive-in bank facilities shall have a minimum storage
lane length of one -hundred (100') feet per teller window
within the property lines of the site when such
development is limited to access off roadways classified
as arterial by the Corpus Christi Urban Transportation
Plan.

V. DRIVEWAY PERMIT REQUIRED
(a) It shall be unlawful for any person, firm or corporation
to construct, reconstruct, alter, repair, remove or replace
a driveway approach on or across any sidewalk, parkway or
other portion of public right of way to provide vehicular
access to private property without an approved Driveway Permit
from the Director of Transportation; provided, however, a
Driveway Permit is not required when such construction,
reconstruction, alteration, repair, removal or replacement
of such driveway approach is part of new construction of
one or two family dwelling units for which an approved Building
Permit from the Director of Building Inspection has been
issued.
(b) The application for a Driveway permit shall include the
following items of information:
(1) The name and address of the applicant.
(2) The name and address of the contractor or of the person,
firm or corporation that owns or manages the site for
which the permit is requested.
(3) The subdivision name, block and lot number and street
address of the site.
(4) A site plan shall be drawn to scale showing the location
and dimensions of the existing and proposed driveways
on the site; the number and layout of approved parking
spaces; and location of existing or proposed sidewalks,
curbs and pipe culverts.
(5) Date and number of an approved Building Permit or evidence
of application for such when development of the lot
includes construction, alteration, enlargement or repair
of a structure or when an existing parking lot is
redesigned or reconstructed.
(6) Application for a Permit to Construct Access Driveway
Facilities for approval by the State Department of
Highways and Public Transportation if such driveway
approach is within the right of way of a state highway.
(c) The Director of Transportation may inspect the site of the
proposed work or improvement and inform the applicant of
any anticipated problems prior to the issuance of the Driveway
Permit within a forty-eight (48) hour period from the date
of the application.

(d) A non-refundable fee of $15.00 shall be paid at the time
application for a Driveway Permit is made and only when the
requirement for a Building Permit is not applicable.
(e) A Driveway Permit shall be void after six (6) months from
date of issuance when the requirement for a Building Permit
is not applicable. A Driveway Permit shall be void after
twelve (12) months from date of issuance when the requirement
for a Building Permit is applicable. The time period of
a valid Driveway Permit may be extended as requested when
construction schedule necessitates such extension.
VI. DRIVEWAY INSPECTION REQUIRED
(a) Permittee shall contact the Driveway Inspector of the
Transportation Department and arrange for and receive an
inspection of such driveway approach within a twenty-four
(24) hour period and prior to applying the driveway surface
materials, i.e., prior to concrete pour or to surface material
over a pipe culvert.
(b) The Driveway Permit shall include a plan, and/or description
of the approved driveway location and design and special
terms and conditions of the approved driveway approaches(es)
and shall be located at the job site for review by the Driveway
Inspector during construction.
VII. AUTHORITY OF THE DRIVEWAY INSPECTOR
(a) The Driveway Inspector may inspect all driveway approaches
for compliance with the provisions of the approved Driveway
Permit and the Manual of Driveway Design and Construction
Standards.
(b) The Driveway Inspector may inform the contractor of the design
and/or construction elements that are not in compliance with
the approved Driveway Permit and Manual of Driveway Design
and Construction Standards and may establish a reasonable
time period for the contractor to comply. Appendix B. Report
of Driveway Inspection.
(c) The Driveway Inspector may suspend a Driveway Permit for
any of the following reasons:
(1) Misrepresentation of facts by the permit holder or his
agent in the application for a Driveway Permit.
(2) Non-compliance with the provisions of the Manual of
Driveway Design and Construction Standards.

(d) If the Driveway Inspector has reason to believe that such
misrepresentation or non-compliance has occurred, he shall
promptly notify the permit holder in writing to stop all
work on such driveway. The stop work notice shall be delivered
or mailed to the permit holder at the address contained in
the permit and shall state the reason for the notice, that
all work on the driveway cease, and that the permit holder
has the opportunity within ten (10) days after the mailing
of the stop work notice to show cause before the Director
of Transportation why the permit should not be suspended.
Thereafter, the Director of Transportation may suspend or
revoke the permit if he determines such misrepresentation
or non-compliance has occurred. The Director of Transportation
will promptly notify the suspended or revoked permit holder
in writing of such action. If a Driveway Permit is revoked,
the revoked permit holder shall promptly remove all driveway
materials installed in connection with the revoked permit
and restore the property to a condition substantially similar
to its condition prior to driveway construction.
VIII. DRIVEWAY DESIGN STANDARDS
(a) DRIVEWAY FREQUENCY
(1) The number of non-residential driveway approaches for
a given lot frontage shall comply with the design
standards adopted herein and shall not exceed the
following frequency:
DRIVEWAY FREQUENCY LOT FRONTAGE (per roadway)

Two driveways 95' to 300' of lot frontage
Three driveways 301' to 600' of lot frontage
Four driveways more than 600' of lot frontage
(2) The location and number of additional driveways for
properties with lot frontage greater than six -hundred
feet (600') shall be based on: the intensity of the
proposed development; available site plan; on the adjacent
geometric roadway design; and on the type of adjacent
traffic control devices in order to minimize traffic
congestion on the adjacent roadways.

(3) Residential circular driveways shall require a minimum
lot frontage of 57' feet on roadways classified as
collector and arterial roadways by the Corpus Christi
Urban Transportation Plan.
(b) MINIMUM SPACING
(1) Minimum spacing between driveway approaches within the
same property lines shall be as follows:

(3) The minimum corner clearance design shall be reduced
as determined by the Director of Transportation when
a shared access driveway has been investigated and not
found feasible and the lot frontage is such that access
to the lot is denied due to the application of the corner
clearance design standard.

(2) The minimum driveway width for non-residential driveways
may be decreased to 15' when one-way traffic movement
is consistent with the internal circulation of the site
and does not result in vehicular conflict between exiting
and entering vehicles to the site and when such driveway
approaches are used by passenger car vehicles and not
by truck vehicles.
(3) The maximum driveway width for industrial driveways
may be increased to 45' upon approval by the Director
of Transportation when it can be shown that vehicles
with a wheelbase greater than WB -50 will use such
driveway. In no instance shall a driveway approach
be in excess of 45' in width.
(4) The curb return radius shall be based on the type of
vehicle using such driveway approach and on the speed
limit of the adjacent roadway using the Design Vehicle
Dimensions and Turning Properties in Appendix C.
(5) The point where the driveway curb return radius falls
tangent to the curb shall be within the extended property
lines normal to the roadway curb line adjacent to the
site.

DRIVEWAY DESIGN STANDARDS FOR SITE DEVELOPMENTS WITH FUEL
PUMP FACILITIES
Driveway design standards for site development that include
fuel pumps parallel to the adjacent roadway were developed
due to the special access needs that characterize such
developments. The following design standards shall apply:
(1) The minimum corner clearance shall be a distance of
twenty-five feet (25') measured from the point of
intersecting right of way lines to the point of tangency
of the curb return radii leading to the driveway approach.
The point of tangency of the curbline corner radius
and that of the curb return radius of the driveway
approach shall not be compounded.
(2) The minimum spacing between driveway approaches within
the same property lines shall be 25' of tangent curb
length.
A minimum distance between the fuel pump island and
the right-of-way or property line shall be 12'.
(4) The minimum property line clearance shall be the curb
return radius.
(3)
IX. SHARED ACCESS DRIVEWAYS
(a)
The feasibility of shared access driveways shall be
investigated where the lot is of such width that the
application of the required design standards results in a
lack of access such that minimum driveway spacing. corner
clearance and property line clearance are satisfied by the
combination of lots served by a shared access driveway.
(b) A shared access driveway shall be accepted when a joint
contractual agreement. plat or easement extending in perpetuity
is entered into by the respective property owners of the
adjacent properties.

X. DRIVEWAY RESTRICTIONS
(a) Driveway restrictions along expressway ramps
(1) If a driveway provides access to and from expressway
frontage roads, it shall not intersect the frontage
road at any point along the curbline of the frontage
road, or along the edge of the pavement within two -hundred
(200') feet downstream from an exit ramp measured in
the direction of traffic flow on the frontage road,
Figure 4.
This distance is measured from a line perpendicular
to the right curbline of the frontage road, drawn through
the point of intersection of the right curbline of an
exit ramp and left curbline of the frontage road, and
be located to minimize danger created by the crossing,
weaving and merging of traffic.
(2) If a driveway provides access to and from expressway
frontage roads, it shall not intersect the frontage
road at any point along the curbline of the frontage
road, or along the edge of pavement if there is no
curbline, within seventy-five (75) feet upstream of
an entrance ramp, Figure 4.
This distance is measured on the frontage road upstream
from a line perpendicular to the right curbline of the
frontage road, drawn through the point of intersection
of the right curbline of an entry ramp and the left
curbline of the frontage road, and be located to minimize
danger created by the crossing, weaving and merging
of traffic.
(3) A driveway restriction greater than seventy-five (75')
upstream of an entrance ramp shall be as determined
by the Director of Transportation for shopping centers
with more than 299,999 square feet of gross leasable
area.
(b) Driveway restriction at intersection right of way line taper
or curvature.
(1) A driveway approach shall be restricted along the distance
of the diagonal straight line taper or along the curvature
between points of tangency that connects the right of
way lines of two intersecting roadways and that defines
a portion of a right turn lane, Figure 5.

(2) This driveway restriction may be modified as determined
by the Director of Transportation if the application
of such restriction results in no access, unsafe or
inadequate access to a lot.
(c) Driveway restrictions along channelized right turn lanes.
A driveway approach along the transition and storage distance
of a channelized right turn lane shall be subject to the
design standards contained herein.
XII. CONSTRUCTION STANDARDS
All driveway approaches shall be constructed as follows:
(a) Driveway approaches on streets having curb and gutter, ramps,
sidewalks and curbs constructed in connection therewith shall
be constructed of concrete having a minimum compressive
strength of two thousand five -hundred (2,500) PSI in
twenty-eight (28) days, and shall have reinforcement consisting
of six inches by six inches (6" x 6") No. 6 wire mesh as
a minimum, and shall have a minimum thickness of six (6)
inches. The minimum thickness of the sidewalk section may
be reduced to four (4) inches where the property served is
used only for one or two-family dwellings.
(b) Driveway approaches connecting to streets that do not have
concrete curb and gutter shall not be constructed of concrete
but shall be constructed of shell or caliche with or without
asphaltic surface; provided, however, that such driveways
which provide access to properties zoned other than R -1A,
R -1B, R -1C, R-TH, R-2, A-1, A -1A or A-2 may be constructed
of reinforced concrete on streets that are classified arterial
or collector, subject to approval of the City Engineer. Such
approval shall be based on the need for the structural strength
to support the anticipated vehicle loads. The owner of
property that the driveway is intended to serve shall furnish
the City Engineer an affidavit stating that no credit of
any type will be requested for said driveway against future
paving assessment programs by the City, that its construction
will not impede drainage of the ditches and that in the event
ditch grade is required to be changed to improve drainage,
the property owner will be responsible for the reconstruction
of the driveway. Appendix B. Access Permit to Construct
Concrete Driveway Approach(es) (connecting to streets without
concrete curb and gutter).
(c) All sidewalk, curbs and gutters shall conform to the standards
and specifications Established by the City Engineer as detailed
in Sec. 49-30 to Sec. 49-39 of the City of Corpus Christi
Code, Appendix A. Standard Street Details.

(d) Driveways shall be designed and constructed so as to provide
for a sidewalk having a minimum width of five (5) feet measured
at right angles to the edge of the right of way when the
sidewalk is tied to the back of the curb on all roadway
classifications. The minimum width may be reduced to four
(4) feet where the sidewalk is constructed more than one
(1') foot from the back of the curb on all roadway
classifications. Such a sidewalk shall be constructed so
as to be in line with existing sidewalk if there is one.
If there is no existing sidewalk, the sidewalk shall be
constructed so as to have one edge thereof located within
the right of way, parallel to and five (5) feet from the
edge of the right of way; and the other edge located within
the right of way parallel to and not more than one foot from
the edge of the right of way; or consistent with the general
practice established by the existence of sidewalks on a
majority of the property within the block where the driveway
is to be placed.
(e) Sidewalk sections shall be constructed at an elevation which
will provide for a minimum of one-fourth (1/4) inch per foot
fall from the edge of the right of way to the top of the
curb. From the edge of the sidewalk section, which is usually
five (5) feet from the edge of the right of way, the driveway
shall ramp down to meet the flow line of the street gutter.
In constructing such driveway ramp, it shall be mandatory
that the back or uppermost edge of the curb and gutter section
be removed.
(f) The grade of all curbs, sidewalks and ramps shall be fixed
by the City Engineer and verified by the Driveway Inspector.
(g) Standard curb, gutter, sidewalk and grass shall be constructed
and unused driveways removed by the owner/developer when
off-street parking facilities are modified and existing
driveways no longer serve such parking facilities.
(h) Drainage pipe culverts for all driveway approaches within
the right of way of state maintained roadways shall be
constructed in accordance with requirements established by
the State Department of Highways and Public Transportation.

(1)
Drainage pipe culverts for all driveway approaches within
the right of way of City maintained roadways shall be
constructed with 6:1 sloped end sections on all roadways
classified as arterial by the Corpus Christi Urban
Transportation Plan with the grade, length and diameter to
be verified by the Driveway Inspector for conformance with
specifications required by the City Engineer.
XII. APPEALS
If relief is desired from the decision of the Director of
Transportation the applicant may appeal to the City Council. The
request for appeal shall be filed in writing to the Director of
Transportation within ten (10) days following such denial, for
scheduling on the City Council agenda.
XIII. PENALITIES
Any contractor or person who violates or fails to comply with
any provision of this article shall be deemed guilty of a
misdemeanor and upon conviction shall be fined not more than the
maximum fine permitted by law. In case a corporation is the
violator of any provision of this article, each officer, agent
and/or employee in any way responsible for such violation thereof
shall be individually and severally liable for the penalties herein
prescribed.
XIV. RESPONSIBILITY OF PERMITTEE
By taking any action in connection with this Division 3 (including,
but not limited to, inspections, reviews, approvals, investigations,
administration, enforcement, record keeping, the granting,
suspension and revocation of permits), the City and its agents
and employees do not in any way represent or undertake to represent
the safety, fitness, or condition of driveways constructed, and
such shall be the sole responsibility of each person constructing
such driveways without relying on any action of the City.

KNOW ALL BY THESE PRESENTS:
This Contract and Agreement entered into on the date of its
execution by and between the undersigned parties hereto, and is authorized
by Corpus Christi City Code Chapter 49, Article II, Division 3, entitled,
Driveway Design and Construction Standards,
WITNESSETH:
WHEREAS, is the owner of a
lot or parcel of land situated in the City of Corpus Christi and more
particularly described as follows:

WHEREAS, is the owner of an
adjoining and contiguous lot or parcel of land situated in the City of
Corpus Christi and more particularly described as follows:
; and
WHEREAS, said described adjoining and contiguous lots share a
common lot boundary line and it is the desire of the parties hereto that
their respective properties be served by a shared access driveway in
accordance with the requirements and standards adopted as a part of the
Corpus Christi City Code.
NOW, THEREFORE, FOR AND IN CONSIDERATION of the exchange of
mutual covenants and conditions herein contained to be kept and performed
by the parties hereto, it is hereby agreed as follows:
1. The parties shall construct or cause to be constructed a
shareo access driveway from the public right-of-way to the interior of the
lots to be served, said driveway may be situated partially and equally on
each lot so that the driveway center line shall be a co -extension of the
property line; provided, however, that said driveway may be located, with
respect to the common property line, in unequal proportions as the parties
may determine.

2. That a shared access driveway utilized under this Agreement
shall be constructed in accordance with the standards and specifications of
Chapter 49, Article II and all other applicable provisions and ordinances
of the City Code. The owner of each lot shall be obligated for reasonable
maintenance and the cost therefor of that portion of the driveway situated
on his respective property.
3. That each of the undersigned parties expressly consent and
agree that the other shall have full and complete right of access to and in
the use of said shared driveway at all times free of all obstructions for
the purpose only of ingress, egress, and regress for said adjoining and
contiguous lots.
4. That each of the parties further expressly agree that in the
event of a conveyance of title to their respective lots by either party,
that the covenants and conditions contained herein shall be expressly
incorporated in such conveyance and said title shall be passed subject
thereto.
5. That the covenants and conditions set forth herein shall
constitute a covenant running with the land and shall hereafter be binding
on the parties hereto, their heirs, executors, administrators and assigns,
and the parties hereto shall cause this Agreement to be recorded in the
Deed Records of Nueces County, Texas as a condition precedent to acceptance
of such shared access driveway as being in compliance with said City Code.
