AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH NUECES COUNTY
FOR REIMBURSEMENT TO THE CITY OF 50 PERCENT OF RIGHT-OF-WAY
ACQUISITION COSTS FOR 14 PARCELS AT VARIOUS LOCATIONS ALONG
PADRE ISLAND DRIVE FROM WEST POINT ROAD TO NEAR HIGHWAY 44
AND IN THE FLOUR BLUFF PORTION OF THE CITY FOR THE PROPOSED
CONSTRUCTION OF A FREEWAY SYSTEM BY THE STATE HIGHWAY
DEPARTMENT; APPROPRIATING $145,000; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute an
agreement with Nueces County providing for reimbursement to the City of 50
percent of right-of-way acquisition costs for 14 parcels at various locations
along Padre Island Drive from West Point Road to near Highway 44 and in the
Flour Bluff portion of the city for the proposed construction of a freeway
system by the State Highway Department all as more fully set forth in the
agreement, a substantial copy of which is attached hereto and made a part
hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated $145,000 from the
No. 220 Street Bond Fund applicable to Project No. 220-86-1.1, Land Acquisition
- Padre Island Drive.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned agreement at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the 31st day of December, 1985.

This Agreement is authorized by Ordinance No. and is entered
into by and between the City of Corpus Christi, Texas, hereinafter called
"City", acting by and through its duly authorized City Manager, Edward A.
Martin, and Nueces County, Texas, hereinafter called "County", said Agreement
pertaining to the acquisition of street right-of-way.
WHEREAS, the State Department of Highways and Public Transportation,
hereinafter called "State", is planning to reconstruct Padre Island Drive from
West Point Road to near Highway 44 and from the east end of the Cayo Del Oso
through the Flour Bluff portion of the City; and
WHEREAS, the State has identified several locations along Padre Island
Drive where additional right-of-way is needed for said construction; and
WHEREAS, the State has requested assistance from the City and/or County
in securing said right-of-way; and
WHEREAS, both the City and the County are agreeable to furnishing said
right-of-way for future Padre Island Drive reconstruction;
NOW, THEREFORE, the City and County agree as follows:
1. The City will prepare appropriate right-of-way maps for the
acquisition of 14 parcels of right-of-way at various locations along Padre
Island Drive as shown on attached Exhibits "A" and "H".
2. The City has estimated the cost of acquisition of said 14 parcels,
including appraisal services, to be $145,000.
3. The City will arrange for necessary appraisal services for said
parcels, will enter into appropriate negotiations with property owners, and
will acquire, either through negotiation or condemnation proceedings as
necessary, all 14 parcels of right-of-way as indicated on attached Exhibits
"A" and "B" and as more fully shown in the files in the offices of the City
Engineer.
4. County agrees to reimburse the City for one half or 50% of all
acquisition costs, appraisal costs, and related expenses pertaining to
acquisition of said right-of-way. City will bill County for its appropriate
share of said acquisition along with an itemized description of costs as
outlined herein after all parcels have been acquired. County will reimburse
the City for such agreed costs within 30 days of receipt of billing notice.
