HomeMy WebLinkAbout19133 ORD - 12/31/1985TEXAS: AN ORDINANCE AUTHORIZING THE EXECUTION OF A QUITCLAIM DEED CONVEYING TO CITIZENS STATE BANK OF CORPUS CHRISTI, AS TRUSTEE, LOT 1, BLOCK 3, WILKINS ACREAGE TRACTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized to execute a Quitclaim Deed conveying to Citizens State Bank of Corpus Christi, as Trustee, Lot 1, Block 3, Wilkins Acreage Tracts, all as more fully set forth in the deed, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned deed at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first readin4 as an emergency measure this the 31st day of December, 1985. ATTEST: ‘242;t -City Secretary APPROVED: a DAY OF DECEMBER, 1985 Assfis nt City Y Attorne Y 04P.281.01 MAYOR THE CITY OF CORPUS CHRISTI, TEXAS 19133 MICROFILMED • QUITCLAIM DEED THE STATE OF TEXAS § COUNTY OF NUECES § WHEREAS, on August 16, 1978, Virgil Wilkins was the owner of a certain 39.6 -acre tract of land described as follows: Being a tract of land containing 39.6 acres, more or less, out of the Mariano Lopez DeHerrera Grant, Abstract No. 606, Nueces County, Texas, also being a portion of that 172.7 -acre tract described in Deed Records of Nueces County, Texas in Volume 26, Page 514; and, WHEREAS, on said date Virgil Wilkins, as owner and subdivider, executed a final plat or said land which is now described as Wilkins Acreage Tracts, Nueces County, Texas, as shown by said map or plat recorded in Volume 44, Pages 48 and 49, of the Map Records of Nueces County, which said plat contains a designation of Lot 1, Block 3, Wilkins Acreage Tracts, as a park, under the requirements of the ordinances of the City of Corpus Christi, Texas; and WHEREAS, the City of Corpus Christi does not now assert any claim to said Lot 1, Block 3, Wilkins Acreage Tracts such property, and desires to Quitclaim any of its right, title and interest in and to such land to the subdivider, his heirs, successors, and assigns; and WHEREAS, by Warranty Deed dated July 9, 1979, Virgil Wilkins conveyed said Lot 1, Block 3, Wilkins Acreage Tracts, Nueces County, Texas, together with other lands to Citizens State Bank, as Trustee; 02F.023.02 EXHIBIT "A" • NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: That the CITY OF CORPUS CHRISTI, TEXAS, a Municipal Corporation situated in Nueces County, Texas, acting by and through its City Manager, Edward A. Martin, hereunto duly authorized, in consideration of the premises, has QUITCLAIMED, and by these presents does QUITCLAIM unto CITIZENS STATE BANK OF CORPUS CHRISTI, AS TRUSTEE, of the County of Nueces, State of Texas, all of its right, title and interest in and to the following described real property situated in Nueces County, Texas, to -wit: Lot 1, Block 3, WILKINS ACREAGE TRACTS, as shown by the Map or Plat thereof of records in Vol. 44, pages 48 and 49, Map Records of Nueces County, Texas, to which reference is here made. TO HAVE AND TO HOLD all of its right, title and interest in and to the above described property and premises unto the said grantee, its successors and assigns forever, so that neither the said City of Corpus Christi, Texas, nor its successors or assigns, shall have, claim or demand any right or title to the aforesaid property, premises or appurtenances or any part thereof.
