AN ORDINANCE
APPROVING THE ASSIGNMENT BY THE JUNIOR LEAGUE OF CORPUS
CHRISTI, INC. TO THE CREATIVE ARTS CENTER, INC., OF THE
LEASE AGREEMENT PERTAINING TO THE LICHTENSTEIN HOUSE, AND
APPROVING AN AMENDMENT TO THE LEASE AGREEMENT CONCERNING
UTILITY SERVICES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
the assignment by the Junior League of Corpus Christi, Inc. to the Creative
Arts Center, Inc., of the lease agreement pertaining to the Lichtenstein
House which lease term runs through May 22, 1996, and that approval of an
amendment to the lease agreement concerning utility services except water
and sewer for any buildings constructed in the future will be the responsi-
bility of the Creative Arts Center, all as more fully set forth in the agree-
ment, a substantial copy of which is attached hereto and made a part hereof,
marked Exhibit "A".

AGREEMENT
THE STATE OF TEXAS
COUNTY OF NUECES
WHEREAS, the City of Corpus Christi, a municipal corporation, herein
called "Lessor," and the Junior League of Corpus Christi, Inc., herein
designated as "Assignor," entered into a lease agreement dated May 23, 1981,
covering certain property known as Lots 5 and 6, Block 70, Beach Portion, a
subdivision of the City of Corpus Christi, Nueces County, Texas, including the
improvements situated thereon known as the "Lichtenstein House," herein refereed
to as "the Agreement," and
WHEREAS, Assignor desires to assign all of its interest in and rights
under the Agreement to the Creative Arts Center, Inc., a Texas nonprofit
corporation, herein designated as "Assignee," and
WHEREAS, Assignee desires that the Agreement be amended to provide for
future construction of additional improvements on and adjacent to the leased
premises.
NOW, THEREFORE, Lessor, Assignor, and Assignee do hereby agree and
covenant as follows:
1. Lessor consents to the assignment of the Agreement and Assignee
agrees to all obligations and duties of Lessee under the Agreement.
2. Lessor and Assignee agree that the Agreement shall hereafter be
amended by adding the following provision:
"9. In the event that Lessee proposes and Lessor consents to the
construction by Lessee of additional improvements on and adjacent to the Leased
Premises, Lessor's obligation to provide at its expense all usual utility
services (except telephone service) shall be limited to the Lichtenstein House,
and Lessee shall provide at its expense all utility services to the additional
improvements except water and sewer service which will be provided by Lessor."
"10. Assignee shall carry with an insurance company or companies
satisfactory to the City a comprehensive general liability insurance policy
covering bodily injury and property damage in reasonable amounts as approved by
the City. Said policy shall be so written as to name the City as additional
insured. The Assignee shall also adequately insure all property, excluding the
building, for which it is custodian or trustee so as to protect itself from
claims which might arise from the loss, damage to, or destruction of said
property."

3. Assignee agrees to pay costs of publication associated with this
assignmentand amendment as required by the City Charter.
IN TESTIMONY WHEREOF, the parties to this agreement have hereunto set
