HomeMy WebLinkAbout19154 ORD - 01/14/1986AN ORDINANCE AUTHORIZING THE EXECUTION OF AMENDMENT NO. 6 TO THE CONTRACT WITH URBAN ENGINEERING FOR DESIGN AND INSPECTION SERVICES ON THE McARDLE ROAD SLIPLINING PROJECT; APPROPRIATING $77,010; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Acting City Manager is hereby authorized to execute Amendment No. 6 to the contract with Urban Engineering for design and inspection services on the McArdle Road Sliplining project, all as more fully set forth in the amendment, a'substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $77,010 from the Sanitary Sewer Bond Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned amendment at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 14th day of January, 1986. ATTEST: O.4.4crita,, APPROVED: 14.1-4 DAY OF JANUARY, 1986 DA ttarney 04P.295.01 MAYOR THE CITY OF CORPUS CHRISTI, TEXAS 19154 MICROFILMED AMENDMENT TO CONTRACT FOR ENGINEERING SERVICES ON MCARDLE ROAD SANITARY SEWER SLIPLINING PHASE IIA THE STATE OF TEXAS § COUNTY OF NUECES § The City of Corpus Christi and Urban Engineering agree to the following amendment to the contract for engineering services regarding the sliplining of the McArdle Road Sanitary Sewer Trunk Main which was authorized by the Corpus Christi City Council on April 12, 1978 by the passage of Ordinance No. 14268. SECTION A. SERVICES Urban Engineering agrees to perform, in addition to the services outlined in Section C, 1 through 9 in the previously approved contract, Design and Resident Inspection Services related to Phase IIA as outlined below. 1. Modify Phase II design to complete plans and specifications for bidding under Phase IIA. 2. Provide resident inspection personnel and services for all phases of inspection at substantially all times the contractor is actively working on the project, provide detailed daily reports and construction activity, and mark up project plan prints with as -built changes and notices. 3. Coordinate day-to-day work details with the City and the Contractor as needed, as well as all basic engineering services required during the course of construction. 4. Provide all staking required during construction. SECTION B. LIMITATIONS The Engineer will, to the best of his ability and in accordance with prudent professional principles, judge and certify to the City whether, in his opinion, the Contractor has or has not complied with the terms of the construction contract. The Engineer does not undertake to guarantee that the Contractor will complete the work, that he will complete it within a certain time, or that defects will not exist in his work, and assumes no responsibility for the job safety practices of the Contractor, whether or not these practices are referred to in the construction specifications and contract documents. The Engineer does not undertake to guarantee that the cost of construction of the project will not exceed any certain amount, other than the fees agreed to herein. SECTION C. COMPENSATION The City will compensate the Engineer for services rendered, a lump sum payment of $77,010. Payments shall be made as follows: 1. For the Design Phase, payment in the amount of $32,605 will be made upon completion of design services. 2. Payment for Resident Inspection Services in the amount of $44,405 will be made as follows: a. After work begins, the Engineer may invoice the City on a monthly basis for partial completion as provided in the E.P.A. Appendix C-1, Required Provisions, attached hereto and made a part hereof. b. Requests for payment shall be accompanied by personnel time summaries, invoices, and other supportive documentation. c. Payments to the Engineer by the City are not to be construed as partial release or acceptance of the overall performance of the work called for under this contract.
