AN ORDINANCE
AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A ZONING
CLASSIFICATION OF "B-4" GENERAL BUSINESS DISTRICT ON THE
SAID AREA OF LAND DESCRIBED AS A PORTION OUT OF LOT 8,
SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS;
AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Roger's Floor Company,
for amendment to the zoning map of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, January 7, 1986, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and that permanent zoning of "B-4" General
Business District, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning

"Section 31-5. The following described tracts of land shall
be zoned and classified as follows:
"B-4" Neighborhood Business District on the following more
particularly described tract:
A tract of land out of Lot 8, Section 6, Flour Bluff and
Encinal Farm and Garden Tracts, as shown on the map thereof
recorded in Volume A, Pages 41, 42, and 43 of the Map
Records of Nueces County, Texas, said tract being more
particularly described by metes and bounds as follows:
BEGINNING 60 feet northeast of the northeast corner of
Buckingham Estates Unit 1, a subdivision with the plat
thereof recorded in Volume 48, Pages 37, 38, and 39 of the
Map Records of Nueces County, Texas, for the southeast
corner and POINT OF BEGINNING of the tract herein described;
THENCE 60 feet northeast of and parallel with the north
boundary of Buckingham Estates Unit 1 North 61°03'09" West
630.00 feet to a point for the southwest corner of this
tract;
THENCE North 28°55'40" East 269.47 feet to a point for the
northwest corner of this tract;
THENCE South 61°03'09" East 630.00 feet to a point on the
west boundary of South Staples Street for the northeast
corner of this tract;
THENCE with the west boundary of South Staples Street South
28°56'02" West 269.47 feet to the POINT OF BEGINNING,
containing in all 3.90 acres, more or less.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved of the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning

change, such finding of an emergency is made and declared requiring suspension
of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the 14th day of
January, 1986.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
