ANNEXING A 25 ACRE TRACT OF LAND OUT OF THE MARIANO De
HERRERA GRANT, ABSTRACT 604, NUECES COUNTY, TEXAS, OWNED BY
WOOD RIVER ASSOCIATES; AND DECLARING AN EMERGENCY.
WHEREAS, the said owners are desirous of contracting with the City for
the annexation of said territory to the City of Corpus Christi; and
WHEREAS, on December 11, 1985, and December 17, 1985, public hearings
were duly held following publication of due notice of said hearing in the
official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for
the consideration of institution of proceedings for the annexation of defined
area wholly within the extraterritorial jurisdiction of the City of Corpus
Christi, more particularly described by metes and bounds as hereinafter set
forth, at which all interested persons were afforded an opportunity to be heard,
and by motion duly made, seconded and carried the said hearing was closed
December 17, 1985; and
WHEREAS, it has been determined by the City Council that the territory
within said tract or parcel of land, now proposed to be annexed, abuts and is
contiguous and adjacent to the City of Corpus Christi and constitutes lands and
territories subject to contractual annexation as provided by the City Charter
Article I, Section 2c; and
WHEREAS, it has been determined that it would be advantageous to the
City and to its citizens and in the public interest to annex the aforesaid lands
and territory hereinafter described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the tract or parcel of land as set forth in
Exhibit "A" attached, being a copy of annexation contract between the City of
Corpus Christi and Wood River Associates, is hereby annexed, said parcel or
tract being described as a portion of the Mariano De Herrera Grant,
Abstract 604, Nueces County, Texas, as described by metes and bounds as follows:

FIELDNOTES for an 18.70 acre tract of land out of a 400
acre tract of the Mariano L. De Herrera Grant, Abstract
606, Nueces County, Texas; said 400 acre tract conveyed
by Bess L. Hurd, et vir, to Nina G. Stewart, widow by
deed dated June 22, 1944 and recorded in Volume 300, Page
153, Deed Records of Nueces County, Texas:
BEGINNING at a 5/8 inch iron rod set on the Northeast
subdivision line of Wood River Unit 2, a map of which is

of Nueces County, Texas, same being the Southwest line of
a 30.00 foot wide Texas Eastern Transmission Corporation
Pipeline and R.O.W. and easement, which is recorded in
Volume 760, Page 214, Deed Records of Nueces County,
Texas for the East corner of Lot 1, Block 25, said Wood
River Unit 2, the North corner of a 50.00 foot wide
access and drainage easement shown as Block 23 of said
Wood River Unit 2 and the South corner of this tract;
THENCE North 43°45'40" West, with said Northeast
subdivision line, at 641.00 feet pass the North corner of
Lot 11, Block 25, Wood River Unit 2, same being the
intersection of said subdivision line with the Southeast
line of Wood River Drive, at 701.00 feet pass the
intersection of the Northwest line of Wood River Drive
and the Southwest line of the aforementioned pipeline
easement, in all a distance of 843.00 feet to a 5/8 inch
iron rod set for the West corner of this tract;
THENCE, leaving the Southwest line of said pipeline
easement, Northwest 46°14'20" East, at 30.00 feet pass
the Northeast line of said pipeline easement, in all a
distance of 190.00 feet to a 5/8 inch iron rod set for a
corner of this tract;
THENCE South 43°45'40" East 22.00 feet to a 5/8 inch iron
rod set for an inside corner of this tract;
THENCE North 46°14'20" East 145.00 feet to a 5/8 inch
iron rod set for the point of curvature of a circular
curve to the left whose radius point bears North

of 03°24'13", a radius of 637.50 feet, a tangent distance
of 18.94 feet and an arc length of 37.87 feet;
THENCE, with said circular curve to the left, 37.87 feet
to a 5/8 inch iron rod set for a corner of this tract;

iron rod set for an inside corner of this tract and the
point of curvature of a circular curve to the left whose

west line of Block 45, a distance of 285.47 feet to a 5/8
inch iron rod set for the West corner of Block 45 and an
inside corner of this tract;
THENCE South 34°41'36" East 40.00 feet to a point on the
centerline of said 80.00 foot wide drainage easement
(Block 45) for a corner of this tract;
THENCE, with the centerline of said 80.00 foot wide

FIELDNOTES for a 6.44 acre tract of land out of a 400.00
acre tract and a 205.80 acre tract of the Mariano L. De
Herrera Grant, Abstract 606, Nueces County, Texas, said
400 acre tract conveyed by Bess L. Hurd, et vir, to Nina
G. Stewart, widow, by deed dated June 22, 1944 and
recorded in Volume 300, Page 153, Deed Records of Nueces
County, Texas and said 205.80 acre tract conveyed by Bess
L. Hurd, et vir, to Nina G. Stewart by deed dated
August 29, 1940 and recorded In Volume 261, Page 235,
Deed Records of Nueces County, Texas.
BEGINNING at a 5/8 inch iron rod set on the Northwest
boundary line of Wood River Drive (60.00 feet wide) for
the East corner of Lot 5, Block 27, Wood River Unit 2, a
map of which is recorded in Volume 45, Pages 190 through
192, Map Records of Nueces County, Texas and for the
South corner of this tract;
THENCE, leaving said Northwest boundary line, North
43°53'15" West, at 110.00 feet pass the North corner of
the aforementioned Lot 5, in all a distance of 820.11
feet to a 5/8 inch iron rod set for a corner of this
tract and the point of curvature of a circular curve to
the right whose radius point bears South 45°13'48" East
299.52 feet and which has a central angle of 02°38'10", a
radius of 299.52 feet, a tangent distance of 6.89 feet
and an arc length of 13.78 feet;
THENCE, with said circular curve to the right, 13.78 feet
to a 5/8 inch iron rod set for an inside corner of this

iron rod set on the Southeast line of an existing 10.00
foot wide utility which is recorded in Volume 1876, Pages
379 through 393, Deed Records of Nueces County, Texas for
the West corner of this tract;
THENCE North 42°08'12" East, along the Southeast line of
said utility easement, 151.21 feet to a 5/8 inch iron rod
set for an angle point of said easement and an angle
point of this tract;
THENCE North 49°08'27" East, continuing along the South-
east line of said utility easement, 123.58 feet to a 5/8
inch iron rod set at the intersection of said Southeast
line with the Southwest line of a 30.00 foot wide Texas
Eastern Transmission Corporation Pipeline R.O.W. and
Easement, which is recorded in Volume 760, Pages 214 and
215, Deed Records of Nueces County, Texas for the North
corner of this tract;

said pipeline easement, 1035.57 feet to a 5/8 inch iron
rod set at the intersection of the Southwest line of said
pipeline easement with the Northwest boundary line of
Wood River Drive (60.00 feet wide) for the East corner of

for the point of curvature of a circular curve to the

THENCE, with said circular curve to the right, 15.71 feet

The above described area shall hereafter be a part of the City of
Corpus Christi, Texas, and shall be subject to the general laws of the State of
Texas, the City Charter, and the ordinances, resolutions, motions, laws, rules
and regulations of the City of Corpus Christi, to all intents and purposes as
the present City of Corpus Christi is so subject, and subject to all the rights,
privileges and burdens thereof.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient and effective administration of City affairs by annexing the
heretofore described tract of land at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three

regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the 14th day of January, 1986.

ANNEXATION CONTRACT
THE STATE OF TEXAS
COUNTY OF NUECES
This Contract and Agreement made and entered into in duplicate originals
by and between Wood River Associates, hereinafter called "owners", and the
City of Corpus Christi, Texas, a home -rule city of more than 200,000
population, a municipal corporation and body politic under the laws of the
State of Texas, situated in Nueces County, Texas, hereinafter called "City",
for good and valuable consideration in hand received by the parties
respectively and upon the covenants and conditions hereafter stated.
WITNESSETH:
The owners are owners in fee simple and of all existing rights, titles
and interests therein of all the following described property located in
Nueces County, Texas, adjacent to and adjoining the corporate limits of the
City of Corpus Christi lying wholly within the extraterritorial jurisdiction
of said city, and in whole or in part, within three hundred feet (300') of
the City's present corporate limits, generally delineated on the map attached
hereto and marked Exhibit "A", and being more particularly described as
follows, to -wit:

FIELDNOTES for an 18.70 acre tract of land out of a 400
acre tract of the Mariano L. De Herrera Grant, Abstract
606, Nueces County, Texas; said 400 acre tract conveyed

It is agreed by and between the parties hereto that the abovedescribed land
and territory shall be included within the corporate boundaries of the City of
Corpus Christi, Texas, and shall become a part thereof, subject to the terms of
Article I, Section 2, of the City Charter of Corpus Christi, as amended, and as
further prescribed by Ordinance No. 11139 of the City of Corpus Christi.
It is further agreed by and between the parties that as an essential
part of the consideration of this Contract, Owners and City will perform the
following conditions:
1. Owners agree to comply with all provisions of the Platting Ordi-
nance.
2. City agrees to commence provision of fire, police, health, sanita-
tion and other usual city services after the effective date of
annexation.
3. City agrees to accept sewer, street and drainage facilities after
construction by owner according to City Platting Ordinance stan-
dards and agrees to maintain such facilities thereafter.
It is further agreed that all of the above conditions shall be binding
upon the successors and assigns of the said Owner and each of them, and shall
constitute covenants running with the land.

ANNEXING A 25 ACRE TRACT OF LAND OUT OF THE MARIANO De
HERRERA GRANT, ABSTRACT 604, NUECES COUNTY, TEXAS, OWNED BY
WOOD RIVER ASSOCIATES; AND DECLARING AN EMERGENCY.
WHEREAS, the said owners are desirous of contracting with the City for
the annexation of said territory to the City of Corpus Christi; and
WHEREAS, on December 11, 1985, and December 17, 1985, public hearings
were duly held following publication of due notice of said hearing in the
official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for
the consideration of institution of proceedings for the annexation of defined
area wholly within the extraterritorial jurisdiction of the City of Corpus
Christi, more particularly described by metes and bounds as hereinafter set
forth, at which all interested persons were afforded an opportunity to be heard,
and by motion duly made, seconded and carried the said hearing was closed
December 17, 1985; and
WHEREAS, it has been determined by the City Council that the territory
within said tract or parcel of land, now proposed to be annexed, abuts and is
contiguous and adjacent to the City of Corpus Christi and constitutes lands and
territories subject to contractual annexation as provided by the City Charter
Article I, Section 2c; and
WHEREAS, it has been determined that it would be advantageous to the
City and to its citizens and in the public interest to annex the aforesaid lands
and territory hereinafter described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
