AN ORDINANCE
AMENDING THE ZONING ORDINANCE UPON APPLICATION OF C.E.B.
DEVELOPMENT COMPANY BY GRANTING A SPECIAL COUNCIL PERMIT FOR
A 40 SQUARE FOOT SIGN ON A PORTION OUT OF LOT 2, BLOCK 1,
STONEGATE NORTH UNIT 1; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of C.E.B. Development
Company, for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, January 14, 1986, at Regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on a portion out
of Lot 2, Block 1, Stonegate North Unit 1, shown by the metes and bounds
description below, situated in the City of Corpus Christi, Nueces County, Texas,
for a 40 square foot sign located near the intersection of Bonner Drive and
Everhart Road, according to the site plan, a copy of which is attached hereto
and made a part hereof, marked Exhibit "A", and subject to all other
considerations of "B-1" Neighborhood Business District with a "SP" Special
Permit and "AB" Professional Office District with a "SP" Special Permit.
Being a 4 foot by 10 foot tract of land for a sign location
out of Lot 2, Block 1, Stonegate North Unit 1, as recorded
in Volume 40, Pages 46 and 47, Map Records of Nueces County,
Texas, said tract being more particularly described by metes
and bounds as follows:

COMMENCING at a point in the intersection of the south
right-of-way line of Curtis Clark Drive with the west
right-of-way line of Everhart Road for the point of
intersection of a circular curve having a central angle of
90°02'55", a radius length of 10.00 feet, a tangent length
of 10.02 feet, and an arc length of 15.73 feet, said point
bears South 28°59'15" West 25 feet from the centerline of
Curtis Clark Drive and North 61°57'50" West 40 feet from the
centerline of Everhart Road;

THENCE with the west right-of-way line of Everhart Road
South 29°02'10" West 555.61 feet to a point;
THENCE leaving Everhart Road North 60°57'50" West 6.0 feet
to a point for the northeast corner of the tract herein
described and POINT OF BEGINNING;
THENCE parallel to and 6 feet from the west right-of-way
line of Everhart Road South 29°02'10" West 4.0 feet to a
point for the southeast corner of this tract;
THENCE North 60°57'50" West 10.0 feet to a point for the
southwest corner of this tract;
THENCE North 29°02'10" East 4.0 feet to a point for the
northwest corner of this tract;
THENCE South 60°57'50" East 10.0 feet to the POINT OF
BEGINNING containing in all 40 square feet.
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the 14th day
of January, 1986.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
