HomeMy WebLinkAbout19169 ORD - 01/21/1986TEXAS: AN ORDINANCE AMENDING THE ZONING ORDINANCE, ARTICLE 26, NONCONFORMING USES, BY ADDING A NEW SECTION 26-10, AND ARTICLE 24, HEIGHT, TRW, AND BULK REQUIREMENTS CHART, BY CHANGING THE MINIMUM SIDE AND REAR YARD REQUIREMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Article 26, Nonconforming uses, of the Zoning Ordinance is hereby amended by adding a new Section 26-10, to hereafter read as follows: Section 26-10 Multiple family dwellings in existence or issued a building permit prior to Tt1 .2 l /184 1986, located in the "R-2", "A-1", 'A -1A", "1-2" and "AT" Districts, which become nonconforming due to an ordinance amendment of Article 24 - Height, Area and Bulk Requirements, pertaining to the side and rear yard regulations shall be allowed to rebuild said structure with the prior side and rear yard requirements of the original building permit, if damaged or destroyed by fire or any natural disaster. Reconstruction must begin within 18 months from the first day of the disaster and be completed within 24 months from the first day a building permit is issued. Such use shall not be subject to Section 26-4 - Destruction of a Nonconforming Use, but shall be subject to all other provisions. SECTION 2. That Article 24, Height, Area, and Bulk Requirements Chart, of the Zoning Ordinance is hereby amended by changing the minimum si e and rear yard requirements to read as follows: 04P.327.01 "R-2" - Multiple Dwelling Minimum Side and Rear Yards in Feet: 1 & 2 Family: 5' 3+ family: 1 story structure 10', plus 5' for each additional story "A-1" - Apartment House Minimum Side and Rear Yards in Feet: 1 & 2 family: 5' 3+ family: 1 story structure 10', plus 5' for each additional story 19169 MICROFILMED • "A -1A" - Apartment House Minimum Side and Rear Yards in Feet: 1 & 2 family: 5' 3+ family: 1 story structure 10', plus 5' for each additional story "A-2" - Apartment House Minimum Side and Rear Yards in Feet: 1 & 2 family: 5' 3+ family: 1 story structure 10', plus 5' for each additional story, but not to exceed a total of 30' "AT" - Apartment -Tourist Minimum Side and Rear Yards in Feet: 1 & 2 family: 10' 3+ family: 1 story structure 10', plus 5' for each additional story, but not to exceed a total of 30' Other: 10' SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of amending the Zoning Ordinance as aforementioned at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 21st day of January, 1986.
