HomeMy WebLinkAbout19171 ORD - 01/21/1986AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF H.E. SAVOY BY GRANTING A SPECIAL COUNCIL PERMIT FOR SINGLE-FAMILY USES ON LOT 9, AND A PORTION OF LOT 10, BLOCK 4, FLOUR BLUFF HEIGHTS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of H.E. Savoy, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 15, 19865, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lot 9 and a portion of Lot 10, Block 4, Flour Bluff Heights, further described by metes and bounds below„ situated in the City of Corpus Christi, Nueces County, Texas, for single-family uses, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A", and subject to all other considerations of "R -A" Residential Acreage District: Describing a 0.215 acre tract of land consisting of Lot 9 and a part of Lot 10, Block 4, Flour Bluff Heights Subdivision as filed for record in Volume 14, Page 9, Nueces County Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: BEGINNING at a point on the Southerly right-of-way line of Skipper Lane for the Northwest corner of said Lot 9 and the Northwest corner of this tract; 04P.330.01 THENCE S 60°36'20" E along said Southerly right-of-way line of Skipper Lane at 50 feet pass the Northeast corner of said 191'71 NAicncr , 'ED Lot 9, a distance in all of 75 feet to a point, the Northeast corner of this tract; THENCE S 29°02'00" W with a line that is both 25 feet from and parallel to the Easterly line of said Lot 9, a distance of 125 feet to a point on the Southerly line common to both Lot 9 and Lot 10, for the Southeast corner of this tract; THENCE N 60°36'20" W with said common Southerly line, at 25 feet pass the Southeast corner of said Lot 9, a distance in all of 75 feet to the Southwest corner of said Lot 9, and the Southwest corner of this tract; THENCE N 29°02'00" E along the Westerly line of said Lot 9, a distance of 125 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. Notwithstanding anything in the way of Special Permit restrictions to the contrary contained in the provisions defining Special Permit (Article 25, Special Permit Regulations of the Zoning Ordinance of the City of Corpus Christi, Texas), the property identified and described herein shall be authorized for full and complete use as a single-family residence only. SECTION 4. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 5. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and 04P.330.01 shall take effect upon first reading as an emergency measure this the 21st day of January, 1986.
