HomeMy WebLinkAbout19191 ORD - 02/18/1986 (2)• AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF RODD FIELD PROPERTIES BY GRANTING A SPECIAL COUNCIL PERMIT FOR A MINIATURE GOLF COURSE ON A PORTION OUT OF LOT 52, BLOCK 1, GREENWAY GARDENS UNIT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Rodd Field Properties, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public, hearing having been held on Tuesday, February 11, 1986, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on a portion out of Lot 52, Block 1, Greenway Gardens Unit 2, further described by metes and bounds below, situated in the City of Corpus Christi, Nueces County, Texas, for a miniature golf course, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A", and subject to all other considerations of "B-1" Neighborhood Business District: FIELDNOTES for 0.3577 acres of land (15,582 square feet) out of Lot 52, Block 1, Greenway Gardens Unit 2, a map of which is recorded in Volume 38, Page 3, Map Records of Nueces County, Texas: 05P.050.01 BEGINNING at a 5/8 inch iron rod set on the Northeast right-of-way line of Sparkle Sea Drive same being the Southwest boundary line of said Lot 52 for the South corner of this survey from which corner the South corner of said Lot 52 bears South 61°00'00" East 199.84 feet; THENCE North 61°00'00" West, with the Northeast right-of-way line of Sparkle Sea Drive,. 120.00 feet to a 5/8 inch iron rod set for the point of curvature of a circular curve to 19191 MICROFILM • 1 the right which has a central angle of 89°57'30", a radius of 10.00 feet, a tangent distance of 9.99 feet for an arc length of 15.70 feet; THENCE with said curve to the right, 15.70 feet to a 5/8 inch iron rod set for the point of tangency on the Southeast right-of-way line of Rodd Field Road; THENCE North 28°57'30" East, with said Southeast right-of-way, along the Northwest boundary line of said Lot 52, 110.00 feet to a 5/8 inch iron rod set for the North corner of this survey; THENCE South 61°00'00" East 130.08 feet to a 5/8 inch iron rod set for the East corner of this survey; THENCE South 29°00'00" West 119.99 feet to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 18th day of February, 1986 ATTE/Alt' T: ' (),4(` City' Secretary U MAYOR THE C Y OF CORPUS CHRISTI, TEXAS APPROVED: gg DAY OF FEBRUARY, 1986 Assistant C"j ` ttorney 05P.050.01 Corpus Christi, Te as /` day ofl , 198; TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
