HomeMy WebLinkAbout19209 ORD - 02/25/1986AN ORDINANCE RATIFYING AND APPROVING SELECTION BY THE STEERING COMMITTEE OF CONSULTANTS AND DON R. BUTLER AS LEGAL COUNSEL; AND AUTHORIZING SAID LEGAL COUNSEL TO INTERVENE ON BEHALF OF THE CITY BEFORE THE PUBLIC UTILITY COMMISSION IN DOCKET NO. 6668 AND TO INTERVENE ON BEHALF OF THE CITY IN THE APPEAL OF PUBLIC UTILITY COMMISSION DOCKET NO. 6072 IN THE DISTRICT COURT OF TRAVIS COUNTY; AND DECLARING AN EMERGENCY. WHEREAS, the Public Utility Regulatory Act, Article 1446 et seq., V.A.T.S. provides for a definite procedure which must be followed by a public utility in order to implement a revised schedule of rates; and WHEREAS, Central Power and Light Company has filed a request with the City for a rate'increase; and - WHEREAS, the City by Ordinance No. 19103 has acted upon the requested rate increase; and WHEREAS, the Public Utility Commission of Texas has consolidated the appeals by Central Power and Light Company of the actions of various cities in its service area under Dockets No. 6375 and No. 6644; and WHEREAS, the Public Utility Commission of Texas has dismissed Docket No. 6325 and has instituted Docket No. 6668 to inquire into the prudency and efficiency of planning and management of the construction of the South Texas Nuclear Project which inquiries and issues are an integral part of Central Power and Light Company's rate request; and WHEREAS, the City has joined with other cities in the Central Power and Light Company system in a cooperative effort to determine a fair and reasonable rate for Central Power and Light Company; and WHEREAS, the City of Corpus Christi will pay all costs for attorneys and rate consultants approved by the Steering Committee and seek and obtain prompt reimbursement from Central Power and Light Company as provided in the Public Utility Regulatory Act; and WHEREAS, it is the opinion of the governing body of the City that it is in the interest of this City and the electric energy users of the City that the City join other cities in continuing its participation in this cooperative effort. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF CORPUS CHRISTI, TEXAS: 02G.090.02 19209 MICROFILMED SECTION 1. The City confirms, ratifies and approves the selection by the Steering Committee of Don R. Butler of Austin, Texas as its attorney, and hereby authorizes its consultants and attorneys to speak for and represent the City in all activities and actions pertaining to PUC Docket No. 6668 and the appeal of Central Power and Light Company of Docket No. 6072 to the District Court of Travis County in the case styled Central Power and No. 384 728,Eght and further authov. re izingic saidtconsult consusion of ltants attorneys, as its proper agents, to request and receive such information as is necessary in its investigation from Central Power and Light Company, and others, and to represent the City in all matters pertaining to the aforesaid dockets before the Public Utility Commission and the courts. Ben Johnson & Associates be engaged as rate consultants to provide an economic analysis of the prudency of the South Texas Nuclear Project. SECTION 4. Legal counsel be authorized to intervene and/or ratifying intervention in the appeal of PUC Docket No. 6072 to the District Court Thef Public Utilitys County inthe case CommissionstofeTexas, CauseCentral Power and 384,728, and subsequent appellate review. 4 SECTION 5. The City Secretary is hereby ordered to deliver a certified copy of this Ordinance to Don R. Butler and Walter W. Hill, Jr. SECTION 6. upon or at Council members, copy a th ched, to findten and declare an emergencyreuest of the Maor due tofive the need for efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25th day of February, 1986.
