HomeMy WebLinkAbout19231 ORD - 03/18/1986AN ORDINANCE CLOSING AND ABANDONING THE PORTION OF 50 -FOOT WIDE 17TH STREET FROM THE SOUTH RIGHT-OF-WAY OF AGNES STREET TO THE NORTH RIGHT-OF-WAY OF MARGUERITE STREET; AND CLOSING AND ABANDONING THE 10 -FOOT WIDE ALLEY IN BLOCK 8, HOME PLACE ADDITION; SUBJECT TO CONDITIONS SET FORTH HEREIN; PROVIDING FOR SEVERANCE. WHEREAS, notice of the time and place for holding a hearing concerning the closing and abandoning the portion of 50 -foot wide 17th Street form the south right-of-way of Agnes Street to the north right-of-way of Marguerite Street and the closing and abandoning the 10 foot wide alley in Block 8, Home Place Addition, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at regular Council Meeting by the City Council of the City of Corpus Christi on 18th day of February, 1986, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portion of rights-of-way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights-of-way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned the portion of 50 -foot wide 17th Street from the south right-of-way of Agnes Street to the north right-of-way of Marguerite Street, shown by plat in Volume A, Page 14, Map Records, Nueces County, Texas; retaining the entire area as utility easement; providing applicant pay $12,675.00 as fair market value for the street area; providing for the installation of curb and gutter across the Agnes/17th Street intersection; providing applicant construct landscaping along Agnes Street in accordance with a plan acceptable to and approved by the City Engineer along with construction of building(s) or parking lots on adjacent propoerty when a building permit(s) is obtained. SECTION 2. That there is hereby closed and abandoned a 10 -foot wide alley in Block 8, Home Place Addition, shown by plat in Volume A, Page 14, Map Records, Nueces County, Texas, retaining the entire alley area as utility easement unless applicant pays relocation costs for the City gas line in said alley; subject to property being replatted at applicant's expense; and providing development takes place within (30) months of the date of this ordinance. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, 02G.119.02 0a/a.2, 192,31 Orr -d.
