AUTHORIZING THE CONVEYANCE BY GENERAL WARRANTY DEED TO
HIALCO-OIC HOUSING ASSISTANCE, INC., LOT 5, AND PORTIONS OF
LOTS 6, 7, AND 8, BLOCK 57, BLUFF SUBDIVISION; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to convey by
general warranty deed to Hialco-OIC Housing Assistance, Inc., Lot 5 and portions
of Lots 6, 7, and 8, Block 57, Bluff Subdivision, in the City of Corpus Christi,
Nueces County, Texas, for a cash consideration of $18,500, all as more fully set
forth in the general warranty deed, a substantial copy of which is attached
hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
conveying the abovementioned general warranty deed at the earliest practicable
date, such finding of an emergency is made and declared requiring suspension of
the Charter rule as to consideration and voting upon ordinances or resolutions
at three regular meetings so that this ordinance is passed and shall take effect
upon first reading as an emergency measure this the 25th day of March, 1986.

WARRANTY DEED
KNOW ALL MEN BY THESE PRESENTS:
That the City of Corpus Christi, a municipal corporation, acting by
and through its, duly authorized officer, of the County of Nueces and State
of Texas for and in consideration of the sum of Eighteen Thousand Five
Hundred Dollars and No Cents ($18,500.00) DOLLARS and other valuable
consideration to the undersigned paid by the grantee herein named, the
receipt of which is hereby acknowledged,
have GRANTED, SOLD AND CONVEYED, and by these presents do GRANT, SELL AND
CONVEY unto HIALCO-OIC HOUSING ASSISTANCE, INC. of the County of Nueces and
State of Texas, subject to the reservations and exceptions hereinafter made
and with the restrictions and upon the covenants below stated; all of the
following described real property in Nueces County, Texas, to -wit:
Lot Five (5), and portions of Lots Six (6), Seven (7)
and Eight (8), Block Fifty -Seven (57), BLUFF
SUBDIVISION, an addition to the City of Corpus Christi,
Nueces County, Texas, according to map or plat recorded
in Volume A, Page 3, Map Records, Nueces County, Texas.
TO HAVE AND TO HOLD the above described premises, together with all
and singular the rights and appurtenances thereto in anywise
unto the said grantee, its successors and assigns forever; and it belonging,
hereby bind itself, its successors and assigns to WARRANT AND FOREVER
DEFEND all and singular the said premises unto the said grantee, its
successors and assigns, against every person whomsoever lawfully claiming
or to claim the same or any part thereof.
The further covenant, consideration and condition is that the following
restrictions shall in all things be observed, followed and complied with:
That the land described herein shall be developed as multi -family housing
Housing and for the elderly and handicapped in accordance with U.S. Department of
construction of UrbanDevelopment
regulations
thereon grnts program; and, that
shall be completed and approved for
occupancy not later than forty-eight (48) months from date hereof.
These covenants and conditions shall be binding upon grantee, its
successors, legal representatives and assigns for a period of four (4)
years from the date hereof, and in case of any violation thereof the title
to said premises shall, without entry or suit, immediately revert to and
vest in the grantor herein, its successors or assigns, and the conveyance
hereunder shall be null and void, and grantor, its successors or assigns
shall be entitled to immediate possession of such premises and the
improvements thereon; and no act or omission upon the

herein, its successors or assigns, shall be a waiver of he artoperation for
enforcement of such condition, provided, however, that such reversion shall
not affect any mortgage or lien which may be in good faith existing upon
said premises or upon any improvements thereon.
Current ad valorem taxes on said property have been prorated, the payment
thereof is assumed by Grantees.
This conveyance is further made and accepted subject to any and all
conditions, restrictions and easements, if any, relating to the hereinabove
described property to the extent only that the same may be in force and
effect as shown of record in the office of the County Clerk of Nueces
County, Texas.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
