HomeMy WebLinkAbout19244 ORD - 03/25/1986AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF HOLIGAN DEVELOPMENT, INC. BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF GREENTREE RECREATIONAL VEHICLE PARK UNIT 1 FROM "B-4" GENERAL BUSINESS DISTRICT WITH "SP" SPECIAL PERMIT TO "T -1B" MOBILE HOME PARK DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Holigan Development, Inc. for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, March 25, 1986, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on a;portion out of Greentree Recreational Vehicle Park Unit 1, in the City of Corpus Christi, Nueces County, Texas, and further described by metes and bounds below, be changed from "B-4" General Business District with a "SP" Special Permit to "T -1B" Mobile Home Park District: FIELDNOTES for a 5.05 acre tract of land, more or less, out of Green Tree Recreational Vehicle Park Unit 1, a map of which is recorded in Volume 40, Page 160, Map Records of Nueces County, Texas: BEGINNING at the North corner of said Green Tree Recreational Vehicle Park Unit 1 for the North corner of this tract; 06P.020.01 THENCE South 61°27'50" East, along the Northeast boundary of said Unit 1, a distance of 256.00 feet, more or less, to the upper East corner of this tract; THENCE South 28°32'10" West 214.00 feet, more or less, to an inside corner of this tract; 1.9244 MICROFILMED THENCE South 61°27'50" East 114.00 feet, more or less, to the lower East corner of this tract; THENCE South 28°32'10" West, at 416.00 feet pass the Northeast boundary of Purdue Road, in all a distance of 446.00 feet to a point on the centerline of Purdue Road for the South corner of this tract; THENCE North 61°27'50" West, along said centerline, same being the common lot line of Lots 6 and 14, Section 40, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43 of said Map Records, 370.00 feet, more or less, to the common corner of Lots 6, 7, 13 and 14, said Section 40, for the West corner of this tract; THENCE North 28°32'10" East, along the common lot line of Lots 6 and 7, at 30.00 feet pass the Southwest corner of said Green Tree Recreational Vehicle Park Unit 1, and continuing along the common boundary of Lots 7 and said Unit 1, in all a distance of 660.00 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25th day of March, 1986. TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
