HomeMy WebLinkAbout19282 ORD - 04/29/1986AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE TEXAS DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE CONSTRUCTION OF AN ILLUMINATION SYSTEM FROM THE NORTH END OF HARBOR BRIDGE TO GULFSPRAY STREET ON U.S. HIGHWAY 181; APPROPRIATING $48,342.50; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with the Texas Department of Highways and Public Transportation providing for the construction of an illumination system from the north end of Harbor Bridge to Gulfspray Street on U.S. Highway 181, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $48,342.50 from the No. 220 Street Bond Fund for the City's share of construction costs to be placed into escrow with the Texas Department of Highways and Public Transportation applicable to Project No. 220-82-2.1, Freeway Illumination Maintenance. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned agreement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 29th day of April, 1986. ATTEST: d y f 6i�y— City "Secretary APPROVED:2%1DAY OF APRIL, 1986 05P.150.01 MAYOR THE CI OF CORPUS CHRISTI, TEXAS 19282 MICROFILMED STATE OF TEXAS COUNTY OF TRAVIS THIS AGREEMENT, made this day of the City of Corpus Christi, Texas, hereinafter called the "City", Party of the First Part, acting by and through its City Manager and the State of Texas, hereinafter called the "State", Party of the Second Part, acting by and through its State Highway and Public Transportation Commission. WHEREAS, it is the desire of the State and City to construct an MC 101-6-81 Nueces County , 1986, by and between illumination system within the limits from the north end of Harbor Bridge to Gulfspray Street on U. S. Highway No. 181. The State will perform or have performed this work and the City will pay fifty per cent (50%) of the cost of this work estimated to be Ninety Six Thousand Six Hundred Eighty Five and No/100 Dollars ($96,685.00), including construction engineering, contingencies and preliminary engineering. It is estimated the City's share is Forty Eight Thousand Three Hundred Forty Two and 50/100 Dollars ($48,342.50) including construction engineering, contingencies and preliminary engineering. NOW THEREFORE, it is understood that the State will perform or have performed this proposed work. The total estimated cost of this work amounts to Ninety Six Thousand Six Hundred Eighty Five and No/100 Dollars ($96,685.00). The City will pay fifty per cent (50%) of the cost of this work and it is estimated the City's share is Forty Eight Thousand Three Hundred Forty Two and 50/100 Dollars ($48,342.50), and the City will transmit to the State with the return of this agreement, executed by the City, a warrant or check made payable to the State Department of Highways and Public Transportation in the amount of Forty Eight Thousand Three Hundred Forty Two and 50/100 Dollars ($48,342.50), to -1- e4f2„ (2) be used in paying for the City's share of the proposed work. If.at inytime is found that this amount is insufficient to pay the City's portion, then the City upon request of the State will forthwith supplement this amount by an amount equal to the City's full estimated or actual share of the cost of this work less the amount previously paid to the State Department of Highways and Public Transportation. In the event the amount as paid is more than the actual cost of the City's share, as herein established, then the excess amount will be returned to the City.
