HomeMy WebLinkAbout19290 ORD - 04/29/1986AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF THE ESTATE OF BLANCHE DAVIS MOORE BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OUT OF LOT 16, SECTION 3, FLOUR BLUFF AND ENCINAL FARM AND GARDEN'TRACTS FROM "AB" PROFESSIONAL OFFICE DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of the Estate of Blanche Davis Moore for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, April 29, 1986, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. 1 SECTION 2. That the zoning on a portion out of Lot 16, Section 3, Flour Bluff and Encinal Farm and Garden Tracts, in the City of Corpus Christi, Nueces County, Texas, further described by metes and bounds below, be changed from "AB" Professional Office District to "B-4" General Business District: FIELDNOTES for a 3.49 acre tract of land out of Lot 16, Section 3, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the centerline of Everhart Road for the West corner of this tract, from which corner the North corner of Lot 1, Block 14, Gardendale Addition No. 3, a map of which is recorded in Volume 12, Page 59, of said Map Records bears South 61°02'29" East 30.00 feet; O5P.153.O1 19290 iVICROrt InIED • THENCE North 28°59'46" East with the centerline of Everhart Road, 230.00 feet more or less, to the North corner of this tract; THENCE South 61°02'29" East, at 30.00 feet pass the Southeast boundary of Everhart Road, in all a distance of 660.00 feet, more or less, to a point on the Southeast boundary of Lot 16 for the East corner of this tract; THENCE South 28°59'46" West 230.00 feet, more or less, to a point on the Northeast boundary of said Gardendale Addition No. 3, for the South corner of this tract; THENCE North 61°02'29" West, with said Northeast boundary of Gardendale Addition No. 3, at 630.00 feet, more or less, pass the aforementioned Southeast boundary of Everhart Road, in all a distance of 660.00 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 29th day of April, 1986.
