HomeMy WebLinkAbout19291 ORD - 04/29/1986AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF THE ESTATE OF BLANCHE DAVIS MOORE BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 2 AND 3, OUT OF LOTS 9 AND 10, SECTION 3, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "R-16" ONE -FAMILY DWELLING DISTRICT ON TRACT 2 AND "R-2" MULTIPLE DWELLING DISTRICT ON TRACT 3 TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of the Estate of Blanche Davis Moore for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, April 29, 1986, at regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. 2. That the Tracts 2 and 3 in Section 3,SFlourrNBluff and EncinalnFarmon and Garden Tracts,out in the Cofoity 9ofaCorpuus Christi, Nueces County, Texas, further described by metes and bounds below, be changed from "R -1B" One -family Dwelling District on Tract 2 and "R-2" Multiple Dwelling District on Tract 3 to "B-4" General Business District: Tract 2 FIELDNOTES for a 4.55 acre tract of land out of Lots 9 and 10, Section 3, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Record of Nueces County, Texas: BEGINNING at a 5/8 inch iron rod found on the North boundary of Gardendale Addition No. 3 for the Northwest corner of Lot 12, Gardendale Addition No. 3, the Northeast corner of Lot 11, Block 11, Gardendale Addition No. 3 and the Southeast 05P.154.01 19'91 MICROFILMED • • corner of this tract, from which corner a 5/8 inch iron rod found at the intersection of the West right-of-way line of South Staples Street with said North boundary of Gardendale Addition No. 3 bears South 60°58'57" East 590.56 feet; THENCE North 61°02'00" West, along the North boundary of Gardendale Addition No. 3, a distance of 660.34 feet to a 1 Block11, corner of Lot 1, inch iron said Gardendale Addition No. 3, the Northeast corner of Burton Lane and the Southwest corner of this tract; THENCE North 28°58'19" East 300.00 feet to a 5/8 inch iron rod found for the Northwest corner of this tract; THENCE South 61°02'00" East, at 659.74 feet pass a 5/8 inch iron rod found on line, in all a distance of 660.00 feet to the Northeast corner of this tract; THENCE South 28°55'43" West 300.00 feet to the POINT OF BEGINNING. Tract 3 FIELDNOTES for a 5.32 acre tract of land out of Lot 9, Section 3, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41 thru 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Northeast boundary of Gardendale Addition No. 3, a map of which is recorded in Volume 12, Page 59 of said Map Records for the North corner of Lot 12, Block 11, said Gardendale Addition No. 3 and the West corner of this tract; THENCE North 28°52'21" East 300.00 feet, more or less, to an inside corner of this tract; THENCE North 60°58'27" West 30.00 feet, more or less, to a corner of this tract; THENCE North 28°52'21" East 65.00 feet to the North corner of this tract; THENCE South 60°58'27" East 660.00 feet, more or less, to a point on the centerline of South Staples Street for the East corner of this tract; THENCE South 29°04'12" West, along said centerline, 365.00 feet, more or less, to the South corner of this tract; 05P.154.01 THENCE North 60°58'27" West 628.74 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for change, efficient administration of City affairs by granting the aforesaid zoning such suspension of the nCharterrf rule asan mtog consideraterency is i�onadeandnavotinglupon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 29th day of April, 1986.
