AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY
ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 ZONING
CLASSIFICATIONS OF "R -1B" ONE -FAMILY DWELLING DISTRICT ON
TRACT 1, "A-2" APARTMENT HOUSE DISTRICT ON TRACT 2, "A -1A"
APARTMENT HOUSE DISTRICT ON TRACT 3, AND "8-1" NEIGHBORHOOD
BUSINESS DISTRICT ON TRACT 4, SAID AREA OF LAND DESCRIBED AS
BEING APPROXIMATELY 90.28 ACRES OUT OF LOTS 25, 26, AND 27,
SECTION 11, AND LOTS 6, 7, AND 8, SECTION 10, FLOUR BLUFF
AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Harris Kaffie, for
amendment to the zoning map of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, May 6, 1986, at regular Council
meeting of the City Council in the Council Chamber at City Hall in the City of
Corpus Christi; and the City Council further finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and that permanent zoning of "R -1B" One -family
Dwelling District on Tract 1, "A-2" Apartment House District on Tract 2, "A -1A"
Apartment House District on Tract 3, and "8-1" Neighborhood Business District on
Tract 4, more fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition of
rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted to
the aforesaid described and hereinafter more fully described parcels or tracts
of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendments would
serve public health, necessity and convenience and the general welfare of the
City and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:

SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance by adding to Section 31-5, to hereafter read as follows, such zoning
classification of the hereinafter described property to be effective upon
annexation:
"Section 31-5. The following described tracts of land shall be zoned and
classified as follows:
"R -1B" One -family Dwelling District on the following described tract of land:
Tract 1
FIELDNOTES for 36.67 acres of land more or less out of
Lots 26 and 27, Section 11, Flour Bluff and Encinal Farm and
Garden Tracts a map of which is recorded in Volume A,
Pages 41-43, Map Records of Nueces County, Texas:
BEGINNING at a 1/2 inch iron rod found for the West corner
of Lot 20, Block 10, Brighton Village Unit 4, a map of which
is recorded in Volume 49, Pages 117-119 for the North corner
of this tract;
THENCE South 61°07'45" East along the Southwest boundary
line of said Brighton Village Unit 4, a distance of 1265.00
feet for the East corner of this tract;
THENCE South 28°52'15" West 1306.68 feet for the South
corner and for the point of curvature of a circular curve to
the right whose radius point bears North 34°55'01" East
2745.44 feet which has a central angle of 08°00'00", a
radius of 2860.13 feet, a tangent distance of 200.00 feet,
and an arc length of 399.35 feet;
THENCE with said circular curve to the right, 93.62 feet for
the point of tangency;
THENCE North 53°07'45" West 100.00 feet for the point of
curvature of a circular curve to the left which has a
central angle of 08°00'00", a radius of 2860.13 feet, a
tangent distance of 200.00 feet, and an arc length of 399.35
feet;
THENCE with said circular curve to the left, 399.35 feet for
the point of tangency;
THENCE North 61°07'45" West 675.36 feet to a point on the
aforementioned Northwest boundary line of Lot 27, for the
West corner of this tract;

and Garden Tracts, a map of which is recorded in Volume A,
Pages 41-43, Map Record of Nueces County, Texas:
BEGINNING at a point on the centerline of Cimarron Boulevard
for the East corner of this tract from which corner the
South corner of Lot 31, Block 6, Brighton Village Unit 4, a
map of which is recorded in Volume 49, Pages 117-119 said
Map Records bears North 61°07'45" West 40.00 feet;
THENCE South 28°57'30" West along the centerline of said
Cimarron Boulevard 760.00 feet more or less for the South
corner of this tract;
THENCE North 61°07'45" West 716.98 feet more or less for the
West corner of this tract;
THENCE North 28°52'15" East 760.00 feet more or less to a
point on the Southwest boundary line of said Brighton
Village Unit 4 for the North corner of this tract;
THENCE South 61°07'45" East 718.14 feet more or less to the
POINT OF BEGINNING.
"8-1" Neighborhood Business District on the following described tract of land:

BEGINNING at a point on the Northwest boundary line of said
Lot 6 for the Northwest corner of this tract from which
corner a 1/2 inch iron rod found for the West corner of
Lot 20, Block 10, Brighton Village Unit 4 a map of which is
recorded in Volume 49, Pages 117-119 said Map Records bears
North 28°53'14" East 1253.48 feet;
THENCE South 61°07'45" East 675.36 feet more or less for the
point of curvature of a circular curve to the right which
has a central angle of 08°00'00", a radius of 2860.13 feet,
a tangent distance of 200.00 feet, and an arc length of
399.35 feet;
THENCE with said circular curve to the right, 399.35 feet
for the point of tangency;
THENCE South 53°07'45" East 100.00 feet more or less for the
point of curvature of a circular curve to the left which has
a central angle of 01°57'14", a radius of 2745.44 feet, a
tangent distance of 46.82 feet and an arc length of 93.62
feet;
THENCE with said circular curve to the left, 93.62 feet for
the Northeast corner of this tract;
THENCE South 28°52'15" West 679.33 feet more or less for the
Southeast corner of this tract;

BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved of the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring suspension
of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the 13th day of May,
1986.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
