AMENDING THE ZONING ORDINANCE UPON APPLICATION OF WILLIAM
BUFORD NICHOLSON BY GRANTING A SPECIAL COUNCIL PERMIT FOR A
RESTAURANT WITH NO ACCESS TO TROJAN DRIVE, WITH A SCREENING
FENCE AND A 5' LANDSCAPED STRIP ALONG TROJAN DRIVE ON A
PORTION OUT OF LOT 1, SECTION 5, BOHEMIAN COLONY LANDS; AND
DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of William Buford
Nicholson, for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, May 13, 1986, at regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on a portion out
of Lot 1, Section 5, Bohemian Colony Lands, further described by metes and
bounds below, situated in the City of Corpus Christi, Nueces County, Texas, for
a restaurant with no access to Trojan Drive, with a screening fence and a 5'
landscaped strip along Trojan Drive, according to the site plan, a copy of which
is attached hereto and made a part hereof, marked Exhibit "A", and subject to
all other considerations of "R -1B" One -family Dwelling District:
That certain tract of land located at the northwest corner
of Greenwood Drive and Trojan Drive as shown on map of
Hacienda Estates Unit 3 recorded in Volume 37, Page 187, of
the Map Records of Nueces County, Texas;
BEGINNING at a point on the south right-of-way line of
Trojan Drive, the point of curvature of a curve to the right
whose central angle is 89°52'45", radius = 10.00', tangent =
9.98' and length = 15.69;

Thence with said curve to the right, an arc distance of
15.69' to the point of termination on the west right-of-way
line of Greenwood Drive;
Thence S 29°02'50" W, with said west line of Greenwood
Drive, a distance of 104.89' more or less, for the south
corner of this tract;
Thence N 61°33'30" W, a distance of 200.00' more or less,
for the west corner of this tract;
Thence N 28°57'15" E, a distance of 137.73' more or less, to
a point on the south line of Trojan Drive, a curve to the
right whose central angle is 11°48'44", radius = 678.33',
tangent = 70.17' and length = 139.84' for the north corner
of this tract;
Thence with said south right-of-way line of Trojan Drive and
with the aforementioned curve to the right, an arc distance
of 40.46' more or less, to the point of curvature of a curve
to the left, whose radius is 11°48'44", radius = 738.33',
tangent = 76.38' and length = 152.21';
Thence continuing with said south line of Trojan Drive and
with the aforementioned curve to the left, an arc distance
of 152.21', more or less, to the POINT OF BEGINNING.
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and

shall take effect upon first reading as an emergency measure this the 13th day
of May, 1986.

or at the present meeting of the City Council.
