HomeMy WebLinkAbout19328 ORD - 05/27/1986AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO PARCELS 7a, 18, AND 32 FOR THE NAVY CLEAR ZONES LAND ACQUISITION PROJECT AND TO ACQUIRE SAID PARCELS FROM THE OWNERS, THE ELIJAH T. JORDAN ESTATE, THE BEULAH SMITH ESTATE, AND CALISTA MARATEA; AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for an on behalf of the City, certain parcels or tracts of land, more fully described hereinafter; and WHEREAS, the Navy Clear Zones Land Acquisition Project requires the acquisition of fee simple title in and to the said parcels or tracts and acquire said parcels from the Owners: Tract 7a, The Elijah T. Jordan Estate; Tract 18, The Beulah Smith Estate; and Tract 32, Calista Maratea; and WHEREAS, the City of Corpus Christi is unable to agreement with the said owners and claimants as to the price and tracts or parcels and damages for the taking thereof by the therefore, determined by the City Council that it is necessary parcel or tract be acquired in fee title through the exercise power of eminent domain for said public purpose; arrive at an value of said City; it is, that the said of the City's NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the Navy Clear Zones Land Acquisition Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcels or tracts of land, excluding mineral interest, said parcel being described by metes and bounds as follows: 07P.046.01 Parcel 7a All that certain tract, piece of parcel of land, lying and being situated in the County of Nueces, State of Texas, and being a portion of Lot No. Eleven (11), in Section No. Forty-seven (47), of the Flour Bluff and Encinal Farm and Garden Tracts, in Nueces County, Texas, as shown by map or plat thereof, recorded in Volume A, Pages 41-43, Map Records of Nueces County, Texas, to which reference is here made in aid of description, the property covered hereby being more particularly described by metes and bounds, as follows, to -wit: 19328 MICROFILMED • Beginning at a point in the Southerly line of that certain tract described as FIRST TRACT in that certain Warranty Deed dated March 27, 1952, from W. G. Boldman to Winship Development Company, now appearing of record in Vol. 547, Pages 240-242, of the Deed Records of Nueces County, Texas, which point is located 130 feet Easterly from the Southwest corner of said FIRST TRACT, for the Southwest corner of this tract; Thence Easterly, along the Southerly line of the aforementioned FIRST TRACT, a distance of 48 feet, for the Southeast corner of this tract; Thence Northerly, parallel to the West line of said FIRST TRACT, a distance of 264 feet to a point in the Northerly line of said FIRST TRACT, for the Northeast corner of this tract; Thence Westerly, along the Northerly line of the said FIRST TRACT, a distance of 48 feet to a point for the Northwest corner of this tract; Thence Southerly, parallel to the West line of said FIRST TRACT, a distance of 264 feet to the place of beginning; SAVE AND EXCEPT, however; A strip of land 25 feet in width, along the South line of said tract has heretofore been dedicated as a street or roadway. Parcel 18 Lot 12, Block 10, Naval Center Subdivision, a subdivision in the City of Corpus Christi, Texas, according to the map or plat thereof, recorded in Volume 8, Page 18, Map Records of Nueces County, Texas. Parcel 32 Lots Thirteen (13), Fourteen (14), Fifteen (15), and Sixteen (16), Block Five (5), NAVAL CENTER, an addition to the City of Corpus Christi, Nueces County, Texas, according to the Map or plat thereof, recorded in Volume 8, Page 18, Map Records, Nueces County, Texas. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its 07P.046.01 • final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for expediting construction of public improvements by acquisition of the aforesaid parcel, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this the 27th day of May, 1986.
