CLOSING AND ABANDONING AN 83 SQUARE FOOT PORTION OF THE 20
FOOT WIDE UTILITY EASEMENT IN LOT 16, BLOCK 25, EGYPTIAN
PLACE UNIT 2, SUBJECT TO THE PROVISIONS LISTED BELOW; AND
DECLARING AN EMERGENCY.
WHEREAS, there exists an 83 square foot portion of the 20 foot wide
utility easement in Lot 16, Block 25, Egyptian Place Unit 2, recorded in
Volume 35, Page 174, Map Records of Nueces County, Texas; and
WHEREAS, it has

SECTION 1. That an 83 square foot portion of the 20 foot wide utility
easement in Lot 16, Block 25, Egyptian Place Unit 2, as recorded in Volume 35,
Page 174, and further described by metes and bounds attached hereto as
Exhibit "A," be and the same is hereby closed for public use and every municipal
purpose, subject to the property being replatted at applicant's expense. The
above described utility easement is hereby abandoned to the owners of the
abutting property in accordance with the laws of the State of Texas, and for the
service and interest of the inhabitants of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned utility easement at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency measure this the 27th day of May,
1986.

Being a portion of Lot 16, Block 25, Egyptian Place Unit 2 as shown
on a plat thereof recorded in Volume 35, Page 174, Map Records of
Nueces County, Texas, said portion being more particularly described
by metes and bounds as follows:
COMMENCING at a 60d nail set at the radius point of a 50 foot radius
cul-de-sac for the dead end of Sahara Drive;
THENCE North 61°30'59":East at 50 feet pass a 5/8 inch iron rod found
in the right-of-way line of said cul-de-sac for the northeast corner
of said Lot 16, continuing with the common boundary line between Lots
16 and 17 in all 117.61 feet to a point for the intersection with the
southeast boundary line of a 20 foot utility easement, said point being
on a curve to the right in a westerly direction whose radius point bears
North 35°27'03" West 1250.59 feet;
THENCE with said curve to the right in a westerly direction along said
southeast boundary line of a 20 foot utility easement an arc distance
of 19.97 feet to a point on said curve from which the radius point bears
North 34°32'09" West 1250.59 feet for the southeast corner of the tract
herein described and POINT OF BEGINNING;
THENCE continuing with said curve to the right in a westerly direction
. along said southeast boundary line of a 20 foot utility easement an arc
distance of 28.76 feet to a point for the southwest corner of this tract
from which the radius point bears North 33°13'06" West 1250.59 feet;
THENCE North 16°08'10" East 6.37 feet to a point for the northwest corner
of this tract;
THENCE North 61°08'10" East 23.94 feet to a point for the northeast
corner of this tract;
THENCE South 34°32'09" East 2 feet to the POINT OF BEGINNING containing
in all 83 square feet, more or less.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
