HomeMy WebLinkAbout19339 ORD - 05/27/1986TEXAS: AN ORDINANCE AMENDING PLATTING ORDINANCE 4168, SECTION VI, EXCEPTIONS, AS AMENDED, BY ADDING A NEW SUBSECTION EXEMPTING PUBLIC SCHOOL DISTRICTS FROM PAYMENT OF CERTAIN DEVELOPMENT FEES ASSOCIATED WITH THE PLATTING OF DEVELOPED SCHOOL SITES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Platting Ordinance 4168, Section VI, Exceptions, as amended, is hereby amended by adding a new subsection to read as follows: H. A public school constructed on or before the adoption of this ordinance as of May 27, 1986, whereby a subdivision plat is submitted of an existing school site, shall be exempt from water and sewer requirements providing all other subdivision requirements of this ordinance and the City Code are met. If it is determined that the water and sewer lines on any plat submitted were installed at the City's expense, then the pro rata fees will be charged to the school district. Required, plat submission fees shall also be exempt for those developed school sites described above. All legal notice advertisement fees and County recording fees associated with the platting process shall be paid by the school district to the Planning Department before the approved final plat is recorded with the Nueces County Clerk's Office. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 27th day of May, 1986.
