HomeMy WebLinkAbout19346 ORD - 06/10/19860 AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO PARCEL 14C -D FOR THE INTERNATIONAL AIRPORT LAND ACQUISITION PROJECT AND TO ACQUIRE SAID PARCEL FROM THE OWNERS, JOHN H. KELLY, ET AL; AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for and on behalf of the City, a certain parcel or tract of land, more fully described hereinafter; and WHEREAS, the International Airport Land Acquisition Project requires the acquisition of fee simple title in and to the said parcel and to acquire said parcel from the Owners; and WHEREAS, agreement with the tract and damages determined by the tract be acquired eminent domain for the City of Corpus Christi is unable to arrive at an said owners and claimants as to the price and value of said for the taking thereof by the City; it is, therefore, City Council that it is necessary that the said parcel or in fee title through the exercise of the City's power of said public purpose; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the International Airport Land Acquisition Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcel of land, excluding mineral interest, said parcel being described by metes and bounds as follows: Being an irregularly shaped tract of land out of Tract 6, Margaret Kelly Lands, shown by plat in Volume 8, Page 40, Map Records, Nueces County, Texas and being more particularly described as follows: Beginning at the southeast corner of Tract 6, for the southeast and beginning corner of the tract herein described; 06P.122.01 Thence West, 3165.58 feet to a point for the southwest corner of Tract 6, and the southwest corner of the tract herein described; Thence North along the west boundary line of said Tract 6, 1892.46 feet to a point in the southerly right-of-way line of F.M. 763 (Joe Mireur Road); 19346 MICROFILMED • Thence in a northeasterly direction, with the southeast right-of-way line of said F.M. 763 and with the arc of a circular curve in said right-of-way whose central angle = 13°58'08", Radius = 1100.00 feet, Tangent = 134.76 feet, a distance of 268.18 feet to a point of tangency; Thence N.46°47'40"E., along said right-of-way 797.64 feet to a point; Thence S.43°11'05"E., 498.31 feet to a point for an interior corner of this tract; Thence N.46°47'40"E., 400.00 feet to a point for an interior corner of this tract; Thence N.43°11'05"W., 498.31 feet to a point on the southerly right-of-way of abovementioned F.M. 763; Thence N.46°47'40"E., along said right-of-way 345.83 feet to a point of curvature of a circular curve to the left in said right-of-way; Thence along said right-of-way and the arc of said curve, whose central angle = 39°02'33, Radius = 1055.00 feet, Tangent = 374.04 feet, a distance of 718.90 feet to a point; Thence S.82°14'53"E., 250.00 feet to a point for an interior corner of this tract; Thence N.03°54'51"E., 174.69 feet to a point for an interior corner of this tract; Thence West 250.00 feet to a point on the easterly right-of-way of said F.M. 763; Thence N.0°05'40"E., 347.39 feet to a point being the southeast corner of the intersection of said F.M. 763 and 60 foot wide Bear Lane; Thence S.89°34'30"E., along the southerly right-of-way of said Bear Lane, 1491.62 feet to a point for the northeast corner of this tract; • Thence South 4210.26 feet to the point of beginning and containing 240.83 acres, more or less. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes. 06P.122.01 SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for expediting construction of public improvements by acquisition of the aforesaid parcel, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this the 10th day of June, 1986.
