HomeMy WebLinkAbout19351 RES - 06/10/1986A RESOLUTION URGING THE BOARD OF DIRECTORS OF THE TEXAS CATASTROPHE PROPERTY INSURANCE ASSOCIATION, THE STATE BOARD OF INSURANCE, THE TEXAS HOUSE OF REPRESENTATIVES INSURANCE COMMITTEE, AND THE TEXAS LEGISLATURE TO TAKE CERTAIN ACTIONS IN REGARD TO THE WINDSTORM INSURANCE POOL; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi has been a leader in the implementation of windstorm resistant building standards for coastal areas; and WHEREAS, the Board of Directors of the Texas1 Catastrophe Property Insurance Association no longer recognizes the Corpus Christi Building Code certificate of occupancy as sufficient indication of compliance with building regulations required for obtaining windstorm insurance through the pool, and instead is requiring execution of a building certificate which is unworkable; and WHEREAS, the insurance industry is proposing that wind design criteria be increased from 120 to 140 miles per hour for buildings in coastal counties insured through the pool; and WHEREAS, the citizens of Corpus Christi who reside in the area seaward of the Intracoastal Canal and specifically on Padre Island are forced to pay much higher premiums for windstorm insurance through the pool than property owners similarly situated in Galveston, and are required to build to more stringent wind design criteria than exists in Galveston; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The Board of Directors of the Texas Catastrophe Property Insurance Association, the State Board of Insurance, the Texas House of Representatives Insurance Committee and the Texas Legislature are urged to take the following actions: Accept the Corpus Christi Building Code certificate of occupancy as sufficient indication of compliance with building regulations required for obtaining windstorm insurance through the Pool; based on periodic approval by the appropriate authorities of the effectiveness of local code enforcement procedures. - Reject insurance industry proposals to increase wind design criteria 140 miles per hour for buildings in coastal counties insured through the pool; whereas the present requirements in Corpus Christi are 105 miles per hour inland of the Intracoastal Canal and 120 miles per hour seaward of the Intracoastal Canal. - Support an amendment to the Catastrophe Property Insurance Pool Act to provide equitable premiums for insureds seaward of the Intracoastal 06P.127.01 193Sl MICROFILMED • Canal in Corpus Christi and in Galveston, and to require similar construction standards in those areas. Support the establishment of an incentive program for political subdivisions which implement adequate code enforcement programs. SECTION 2. That the City Secretary be directed to forward copies of this Resolution to the Texas Catastrophe Property Insurance Association, the State Board of Insurance, the House Insurance Committee, the members of the Texas Legislature representing this area, and the Governor of Texas. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the necessity to urge the State Agencies and State Government to accept the recommendations of the City of Corpus Christi Building Code Board of Appeals and Builder's Association, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this the 10th day of June, 1986.
