HomeMy WebLinkAbout19383 ORD - 07/15/1986AN ORDINANCE ORDERING AN ELECTION TO BE HELD WITHIN THE CITY OF CORPUS CHRISTI, TEXAS, FOR THE PURPOSE OF DETERMINING WHETHER OR NOT CERTAIN TERRITORY ADJACENT TO THE CITY OF CORPUS CHRISTI AS MORE FULLY DESCRIBED BY LOTS AND BLOCKS OR METES AND BOUNDS ON FILE IN THE OFFICES OF THE CITY SECRETARY AND THE PLANNING DEPARTMENT, AND MADE A PART HEREOF BY REFERENCE THE SAME AS IF COPIED VERBATIM HEREIN, SHALL BE ANNEXED TO THE CITY OF CORPUS CHRISTI; DEFINING THE TERRITORY TO BE ANNEXED; PROVIDING PROCEDURE FOR THE HOLDING OF SUCH ELECTION; PRESCRIBING THE FORM OF NOTICE OF ELECTION; PROVIDING FOR PUBLICATION THEREOF; PROVIDING FOR FORM OF BALLOT AT EACH POLLING PLACE; ENACTING PROVISIONS INSTANT TO AND RELATING TO THE PURPOSE OF THIS ORDINANCE; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Corpus Christi desires to submit to the voters of the City the question of annexation of certain tracts of land, more fully described herein; and WHEREAS, pursuant to the Municipal Annexation Act, as amended, public hearings were held, including a hearing within the area proposed to be annexed, on June 23 and 24, 1986. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That an election be held on the ninth day of August, 1986, within the City of Corpus Christi, and that there be submitted at said election in English and Spanish two (2) propositions to the qualified voters of said City the question of whether or not certain territory being described generally in said propositions as hereinafter set forth and all as more particularly described by metes and bounds or lots and blocks and maps or plats thereof on file in the offices of the City Secretary and the Planning Department, and made a part hereof by reference the same as if copied verbatim herein: 19383 M1CROFLIMED PROPOSITION 1 (NUECES COUNTY) AREA A, TRACT 1 OF 6 A 489 -acre tract, more or less, bounded on the north by the present city limit line which is 500' south of and parallel to the north right-of-way line of Whitecap Boulevard, on the south by the Nueces County-Kleberg County line, on the east by the Gulf of Mexico and on the west of Park Road 22. AREA A, TRACT 2 OF 6 A 394 -acre tract, more or less, bounded on the north by the present Padre Island Investment Corporation 'property line, southeast of Park Road 53, on the south by Whitecap Boulevard, on the east by the present city limit line, west of the Gulf of Mexico and on the west by Park Road 22. AREA A, TRACT 3 OF 6 A 22 -acre tract, more or less, surrounded by the present city limits, bounded on the north, east and south by the Padre Isles golf course and on the west of Dasmarinas Drive, generally located west of Park Road 22 and north of Whitecap Boulevard. AREA A, TRACT 4 OF 6 A 21 -acre tract, more or less, surrounded by the present city limits, bounded on the north and east by the Padre Isles golf course, on the south by Whitecap Boulevard and on the west by Dasmarinas Drive. AREA A, TRACT 5 OF 6 A 313 -acre tract, more or less, surrounded by the present city limits, bounded on the north by the north subdivision boundary line of Commodores Cove, on the east by the Padre Isles golf course and Aquarius Street, on the south by the north line common to Barataria Bay Subdivision Unit 4 and Point Tesoro Subdivision Unit 3 and on the west by the Laguna Madre. Said area is general- ly located west of Park Road 22 and south of Commodores Drive. AREA A, TRACT 6 OF 6 An 844 -acre tract, more or less, bounded on the north by the present city limit line, on the east by the present city limit line west of Park Road 22, on the south by the Nueces County- Kleberg County line and on the west by the Laguna Madre. AREA B A 3.65 square mile tract, more or less, bounded on the north by the Mustang Island State Park, on the east by the Mustang Island State Park and the Gulf of Mexico, on the south by the present city limits and the north property line of Padre Island Invest- ment Corporation and on the west by the Laguna Madre. 41.099.bo9 -2- • PROPOSITION 2 (Kleberg County) AREA C A 56.6 square mile tract, more or less, bounded on the north by the present city limit line and the Nueces County-Kleberg County line, on the east by the shoreline of the Gulf of Mexico and the southerly extension of the present city limit line which is two miles from and parallel to the shoreline, on the south by the present five mile extraterritorial jurisdiction line, and on the west by the west shoreline of the Laguna Madre. A more particular metes and bounds description of each of the foregoing tracts of land is filed in offices of the City Secretary and the Planning Department, City of Corpus Christi, Nueces County, Texas. SECTION 2. That the official ballot for said election shall be, except for caption and date and other formalities as may be provided by law for the form of said ballot, as hereinafter set forth, and the two (2) propositions to be voted on at said election and the words appearing on the ballots shall be as follows: 41.099.bo9 -3- "PROPOSITION 1 (NUECES COUNTY) Shall the City of Corpus Christi, by ordinance, annex to the City of Corpus Christi and its corporate limits certain additional territory described generally as follows: AREA A, TRACT 1 OF 6 A 489 -acre tract, more or less, bounded on the north by the present city limit line which is 500' south of and parallel to the north right-of-way line of Whitecap Boulevard, on the south by the Nueces County-Kleberg County line, on the east by the Gulf of Mexico and on the west of Park Road 22. PROPOSITION 2 (KLEBERG COUNTY) Shall the City of Corpus Christi, by ordinance, YES annex to the City of Corpus Christi and its corporate limits certain additional territory NO described generally as follows: AREA C A 56.6 square mile tract, more or less, bounded on the north by the present city limit line and the Nueces County-Kleberg County line, on the east by the shoreline of the Gulf of Mexico and the southerly extension of the present city limit line which is two miles from and parallel to the shoreline, on the south by the present five mile extraterritorial jurisdiction line, and on the west by the west shoreline of the Laguna Madre." SECTION 3. If at said election a majority of the duly qualified voters who reside within the City of Corpus Christi voting at said election shall vote in favor of the annexation to the City of Corpus Christi of the territory and areas herein described and referred to herein, and as generally provided in the two (2) Annexation Propositions, or either of them, the City Council shall, by ordinance, annex and receive such territory and areas, as a part of said City, and thereafter such territory and areas so annexed and received shall be a part of the City of Corpus Christi, Texas. SECTION 4. Staples Woodlawn School 1110 Woodlawn Yeager School 5414 Tripoli Flour Bluff School Tax Office 2300 Waldron *That portion lying within the City Limits * Esa porcion dentro los limites de la ciudad 500.02 • The presiding judges shall be authorized to select such clerks or other assistants provided by law, as may be deemed necessary and said election is to be held under authority of City Charter Article I, Sec. 2(a), as amended, and in accordance with the election laws of the State of Texas, insofar as they are applicable. The maximum number of judges and clerks at each polling place shall not exceed five, and the rate of pay shall be established at $5.00 per hour for each judge and clerk, and a fee of $25.00 is established for judges for delivering election returns. The polls shall be open from 7:00 o'clock a.m., to 7:00 o'clock p.m., on the date of the said election. SECTION 5. Armando Chapa, whose office is situated at the Office of the City Secretary, Third Floor, City Hall, 302 S. Shoreline, Corpus Christi, Texas, is hereby appointed Election Manager and Judge of said election,.and he is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State, and the said Armando Chapa is appointed to hold such election, in accordance with the Texas Election Code. SECTION 6. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots shall be used. Absentee voting in person shall be conducted in the Lobby of City Hall on the First Floor of the City Hall, 302 S. Shoreline, Corpus Christi, Texas, which is hereby designated as an extension of the City Secretary's Office, from 8:00 a.m. to 5:00 p.m., Monday through Friday, beginning on July 21, 1986 and ending on Tuesday, August 5, 1986. 41.099.bo9 -13- SECTION 7. The City Secretary is directed to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 8. By approving and signing this ordinance, the Mayor officially confirms as his action all matters recited in the ordinance which by law come within his jurisdiction. SECTION 9. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision, proposition or portion thereof shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision, proposition or portion thereof, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision or proposition hereof be given full force and effect for its purpose. SECTION 10. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the necessity for the governing body of the City of Corpus Christi to order the aforesaid election and that the notice for such election should be published and posted and that a special City election for the annexation of the territory hereinabove described shall.be held on August 9, 1986, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 15th day of July, 1986. 41.099.bo9 -14- • Page '15 ATTEST: y ecretary APPROVED: (day of HAL GEORGE, CITY ATTOR EY , 1986.
