AN ORDINANCE
AUTHORIZING THE EXECUTION OF A CONTRACT WITH THE CORPUS
CHRISTI INDEPENDENT SCHOOL DISTRICT FOR THE CITY'S ESTIMATED
SHARE OF CONSTRUCTION COST OF A 24 INCH REINFORCED CONCRETE
PIPE FROM WOOLDRIDGE ROAD SOUTHERLY APPROXIMATELY 650 FEET
TO SERVICE THE DRAINAGE REQUIREMENTS OF THE BLANCHE •MOORE
SCHOOL TRACT; APPROPRIATING $17,500; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager is hereby authorized to execute a
contract with the Corpus Christi Independent School District for the City's
estimated share of construction cost of a 24 inch reinforced concrete pipe from
Wooldridge Road southerly approximately 650 feet to service the drainage
requirements of the Blanche Moore School Tract, all as more fully set forth in
the contract, a substantial copy of which is attached hereto and made a part
hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $17,500 from the No. 295
Storm Sewer Bond Fund applicable to Project No. 295-86-44-2.1, Blanche Moore
School Tract Storm Sewer.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the abovementioned contract at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect upon
first reading as an emergency measure this the 5th day of August, 1986.

This Agreement is authorized by Ordinance No. and is entered
into by and between the City of Corpus Christi, Texas, hereinafter called
"City", acting by and through its duly authorized City Manager, Craig A.
McDowell, and Corpus Christi Independent School District, hereinafter called
"District".
WHEREAS, the District is the owner of a tract of land to be platted as
Blanche Moore School Subdivision as shown on Exhibit "A" attached hereto and
made a part hereof; and
WHEREAS, the District is responsible for development of adequate storm
drainage facilities for this subdivision, also as shown on the attached
Exhibit "A"; and
WHEREAS, the City desires to provide adequate storm drainage facilities
for future improvements to Wooldridge Road, also as shown on attached
Exhibit "A";
NOW, THEREFORE, the City and District agree as follows:
(1) The District shall cause to be constructed the storm sewer system as
shown on the attached Exhibit "A". These facilities shall be constructed in
accordance with detailed construction plans and specifications prepared by a
registered professional engineer in the State of Texas and reviewed and
approved by the City. Plan preparation and construction shall be contracted
for and financed by the District.
(2) The City shall reimburse the District for the construction cost plus
8% of construction cost for engineering and administration for the 24 -inch
diameter reinforced concrete pipe from Wooldridge Road southerly approximately
650 feet. The estimated cost of this work is $17,500.00. The actual amount
shall be determined from actual quantities installed and actual unit bid
prices.
(3) The District shall indemnify and save harmless and defend the City
of Corpus Christi, its officers, agents and employees against any and all
lawsuits, claims, demands, liabilities, losses or expenses, including court
costs and attorneys' fees, for or on account of any injury to any person, or
any death at any time resulting from such injury, or damage to any property,
which may arise or which may be alleged to have arisen out of or in connection
with this project.

(4) This Agreement shall be executed in duplicate, both of which shall
be considered one instrument. When both copies have been executed by the City
and at least one duplicate has been executed by the District, this Agreement
shall become effective and shall be binding upon and shall inure to the
benefit of the parties and their respective heirs, successors and assigns.
