HomeMy WebLinkAbout19422 ORD - 08/05/1986AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE OFFICE OF THE GOVERNOR OF THE STATE OF TEXAS TO DESIGNATE THE CITY OF CORPUS CHRISTI AS THE METROPOLITAN PLANNING ORGANIZATION FOR THE CORPUS CHRISTI URBANIZED AREA; AND DECLARING AN EMERGENCY. WHEREAS, Section 112 of the Federal -Aid Highways Act of 1973, as amended, allocates planning funds to designated Metropolitan Planning Organizations for the support of the continuing, comprehensive, and cooperative urban transportation planning process in urbanized areas; and WHEREAS, the current agreement between the Office of the Governor of the State of Texas and the City of Corpus Christi, designating the City of Corpus Christi as the Metropolitan Planning Organization for the Corpus Christi urbanized area, will terminate on August 31, 1986; and WHEREAS, the Transportation Planning Committee, established by an agreement dated March 9, 1981, among the State Department of Highways and Public Transportation, the Cities of Corpus Christi and Portland, and the Counties of Nueces and San Patricio, recommended by motion the redesignation of the City of Corpus Christi as the Metropolitan Planning Organization for the Corpus Christi urbanized area on June 23, 1986; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a two year agreement, effective September 1, 1986, with the Office of the Governor of the State of Texas to redesignate the City of Corpus Christi as the Metropolitan Planning Organization for the Corpus Christi urbanized area in compliance with the Federal -Aid Highways Act of 1973, as amended; and that such agreement shall have .substantially the form as attached hereto, marked Exhibit "A." SECTION 2. City Secretary APPROVED: 21 DAY OF JULY, 1986 HAL GEORGE, CITY ATTORNEY B yA5 1 t t Cl y At ,� rney 08P.032.01 MAYO THE CITY OF CORPUS CHRISTI, TEXAS MICROFILMED 19422 AGREEMENT STATE OF TEXAS § COUNTY OF TRAVIS § THIS AGREEMENT, made this the and between the Office of the Governor the Office of the Governor, and the through the Office of the City Number , hereafter known day of , A.D. 1986, by of the State of Texas, hereafter known as City of Corpus Christi, acting by and Manager so authorized by Ordinance as the City, WITNESSES THAT: WHEREAS Section 112 of the Federal -Aid Highways Act of 1973, as amended, allocates planning funds to designated Metropolitan Planning Organizations for the support of the continuing, comprehensive, and cooperative urban transportation planning process in urbanized areas; and WHEREAS the Federal Highway Administration, in accordance Section 112, intends to fund the Metropolitan Planning Organization for the Corpus Christi urbanized area; and WHEREAS it is the desire both of the Office of the Governor City, that the urban transportation planning process be comprehensive, and cooperative, and that it also be as integrated with other area -wide planning in the urbanized area; and WHEREAS several local governments in the Corpus Christi urbanized area have from time to time agreed to participate in a continuing, comprehensive, and cooperative urban transportation planning process, pursuant to Title 23, U.S.C.; and with said designated and of the continuing, as possible WHEREAS the Transportation Planning Committee established by said local governments recommended the redesignation of the City as the Metropolitan Planning Organization for the Corpus Christi urbanized area on June 23, 1986; NOW, THEREFORE, THE OFFICE OF THE GOVERNOR OF THE STATE OF TEXAS AND THE CITY OF CORPUS CHRISTI HEREBY AGREE: Section 1. THAT the City shall be the metropolitan Planning Organization designated for the Corpus Christi urbanized area; and Section 2. THAT the Metropolitan Planning Organization shall conduct continuing, comprehensive and cooperative urban transportation planning in accordance with all applicable laws and regulations, including, but not limited to the following: The Federal -Aid Highways Act of 1973, as amended; and Section 134 of Chapter 1 of Title 23 U.S.C.; and The Agreement, dated March 9, 1981, among the State Department of Highways and Public Transportation, the Cities 08P.032.01 of Corpus Christi and Portland, and the Counties of Nueces and San Patricio, which Agreement constitutes the Corpus, Christi Urban Transportation Study Agreement, or the successor to such Agreement; and Section 3. THAT the Metropolitan Planning Organization shall contract with the State Department of Highways and Public Transportation for planning funds allocated by Section 112 of the Federal -Aid Highways Act of 1973, as amended, incurring all expenses involved in the urban transportation planning process, until reimbursed for such expenses by said Department; and Section 4. THAT the State Department of Highways and Public Transportation shall periodically reimburse the Metropolitan Planning Organization for expenses incurred, when said Department shall have audited and approved such expenses for planning funds allocated by Section 112 of the Federal -Aid Highways Act of 1973, as amended, and Section 5. THAT this present agreement in no way establishes any activity or process infringing on or interfering with the statutory authority and obligation of the State Department of Highways and Public Transportation; and Section 6. THAT this present agreement may be renewed, renegotiated or terminated either by the Office of the Governor or by the City as and when necessary to meet changing conditions; and Section 7. THAT this present Agreement shall come into effect on September 1, 1986; and Section 8. THAT, unless renewed, renegotiated or terminated earlier, this present agreement shall terminate on August 31, 1988.
