HomeMy WebLinkAbout19432 ORD - 08/12/1986AN ORDINANCE CLOSING AND ABANDONING AN APPROXIMATE 158 SQUARE FOOT PORTION OF A 15 FOOT WIDE UTILITY EASEMENT IN LOT 3, BLOCK 8, SOLAR ESTATES UNIT 1, SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists an approximate 158 square foot portion of a 15 foot wide utility easement in Lot 3, Block 8, Solar Estates Unit 1, recorded in Volume 42, Pages 13-14, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That an approximately 158 square foot portion of a 15 foot wide utility easement in Lot 3, Block 8, Solar Estates Unit 1, as recorded in Volume 42, Pages 13-14, and further described by a metes and bounds description attached hereto as Exhibit "A," be and, the same is hereby closed for public use and every municipal purpose, subject to the applicant paying the City Gas Division $600 to relocate a two inch gas line, paying Central Power & Light Company $600 to adjust power lines, securing an additional 5 foot by 30 foot utility easement on adjacent property north of the existing easement area, obtaining a building permit for the addition to the house to include payment of all associated fees and costs required to bring structure into compliance with building code, replatting the lot to show the easement closure and additional easement dedication, executing a hold harmless instrument in favor of the City. The above described portion of a utility easement is hereby abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the abovementioned portion of a utility easement at the earliest pr-acticab)e date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is 08P.058.01 19432 MtC,ROVII yIED • passed and shall take effect upon first reading as an emergency measure this the 12th day of August, 1986.
