AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CHURCH'S
FRIED CHICKEN BY GRANTING A REVISED SPECIAL COUNCIL PERMIT
FOR A DRIVE-THRU RESTAURANT ON A PORTION OUT OF LOT 1,
SECTION 5, BOHEMIAN COLONY LANDS; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Church's Fried
Chicken, for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, August 19, 1986, at regular
Council meeting of the City Council in the Council Chamber at City Hall in the
City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on a portion out
of Lot 1, Section 5, Bohemian Colony Lands, situated in the City of Corpus
Christi, Nueces County, Texas, and described by metes and bounds below, for a
drive-thru restaurant, according to the site plan, a copy of which is attached
hereto and made a part hereof, marked Exhibit "A", and subject to all other
considerations of "R -1B" One -family Dwelling District:
Being 0.58± acres of land located at the southwest corner of
Greenwood Drive and Trojan Drive as shown on map of Hacienda
Estates Unit 3 recorded in Volume 37, Page 187, of the Map
Records of Nueces County, Texas;
BEGINNING at a point on the south right-of-way line of
Trojan Drive, the point of curvature of a curve to the right
whose central angle is 90°31'19", radius = 10.00', tangent =
10.09', and length = 15.80';
Thence, with said curve to the right, an arc distance of
15.80' to the point of termination on the west right-of-way
line of Greenwood Drive;
Thence, S 29°02'50" W, with said west line of Greenwood
Drive, a distance of 104.89' more or less, for the south
corner of this tract;

Thence, N 61°33'30" W, a distance of 200.00' more or less,
for the west corner of this tract;
Thence, N 28°57'15" E, a distance of 137.73' more or less,
to a point on the south line of Trojan Drive, a curve to the
right whose central angle is 03°25'04", radius = 678.33',
tangent = 20.24', and length = 40.46' for the north corner
of this tract;
Thence with said south right-of-way line of Trojan Drive and
with the aforementioned curve to the right, an arc distance
of 40.46' more or less, to the point of curvature of a curve
to the left, whose central angle is 11°43'43", radius =
738.33', tangent = 75.83', and length = 151.14';
Thence continuing with said south line of Trojan Drive and
with the aforementioned curve to the left, an arc distance
of 151.14', more or less, to the POINT OF BEGINNING.
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the 19th day
of August, 196.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three

and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
