CLOSING AND ABANDONING THE UTILITY EASEMENT IN LOTS 10
THROUGH 19 AND A PORTION OF LOT 9, BLOCK 1, ROOSEVELT PLACE
SUBDIVISION, SUBJECT TO THE PROVISIONS LISTED BELOW; AND
DECLARING AN EMERGENCY.
WHEREAS, there exists the utility easement in Lots 10 through 19 and a
portion of Lot 9, Block 1, Roosevelt Place Subdivision, recorded in Volume 8,
Pages 7 and 8, Map Records of Nueces County, Texas; and
WHEREAS, it has

SECTION 1. That the utility easement in Lots 10 through 19 and a
portion of Lot 9, Block 1, Roosevelt Place Subdivision, as recorded in Volume 8,
Pages 7 and 8, Map Records of Nueces County, Texas, and further described by a
metes and bounds description, a copy of which is attached hereto as Exhibit "A,"
be and the same is hereby closed for public use and every municipal purpose,
subject to the property being replatted at applicant's expense, and providing
applicant pay relocation costs for moving or abandoning the existing water, gas,
electrical, and telephone lines therein. The above described utility easement
is hereby abandoned to the owners of the abutting property in accordance with
the laws of the State of Texas, and for the service and interest of the
inhabitants of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned utility easement at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and shall

Description of 0.081 acres of land, more or less, being out of
lots 9 thru 14 and lots 16 thru 19, all in block 1, Roosevelt Place,
a map of which is recorded in volume 8, pages 7 and 8, Map Records,
Nueces County, Texas, and also out of lot 15A, said block 1, Roosevelt
Place, a map of which is recorded in volume 26, page 47, Map Records,
Nueces County, Texas and being a strip of land 10' in width, 5' on
either side of the centerline described by metes and bounds as follows:
Said centerline of 10' strip containing 0.081 acres of land
begins at the easternmost corner of said lot 19 for the easternmost
end of said centerline;
Thence along the common boundary line of said lot 19 on the south
and said lots 9 and 10 on the north N61deg40'00"W 33.24 to a 5/8" iron
rod found for an interior southerly corner of said lot 10 and turning
point to -the -left of the centerline described herein;
Thence along the common boundary line of a portion of said lot 19,
lots 18 and 17 and a portion of lot 16 on the south and a portion of
lot.10, lots 11, 12, 13 and a portion of lot 14 on the north, due WEST
at 220.24' pass the east boundary line of said lot 15A, in all a
distance of 320.24' to a 5/8" iron rod set in the east right-of-way
line of Port Avenue for the westernmost end of the centerline herein
described, said westernmost end of centerline bears along said east
right-of-way line SOOdeg53'55"E 110.04' from a point where said east
right-of-way line of Port Avenue begins to turn to the east to the
south right-of-way line of Morgan Avenue along a circular curve of
10' radius.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
