HomeMy WebLinkAbout19482 ORD - 09/16/1986TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO RENEW A CONTRACT BETWEEN THE CITY OF CORPUS CHRISTI AND THE TEXAS PARKS AND WILDLIFE DEPARTMENT FOR LEASE BY THE TEXAS PARKS AND WILDLIFE DEPARTMENT OF A PART OF A 1.23 -ACRE TRACT OR PARCEL AT THE SOUTH END OF LAKE CORPUS CHRISTI STATE PARK FOR RECREATIONAL PURPOSES, FOR A TERM OF FIVE YEARS AND RENEWAL FOR ADDITIONAL TERMS UPON AGREEMENT OF THE PARTIES, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT A" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to renew a contract between the City of Corpus Christi and the Texas Parks and Wildlife Department for lease by the said Texas Parks and Wildlife Department of a part of a 1.23 -acre tract or parcel at the South end of Lake Corpus Christi State Park for recreational purposes, for an additional term of five years and renewable for additional terms upon agreement of the parties, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked as Exhibit A. 05P.202.01 19482 MICROFILMED THE STATE OF TEXAS § COUNTY OF NUECES § LEASE AGREEMENT KNOW ALL MEN BY THESE PRESENTS: This Contract is made by and between the City of Corpus Christi, Texas (hereinafter "City") and the Texas Parks and Wildlife Department (hereinafter "Department"). Whereas, it is the desire of the City and Department that the lease of the hereinafter described tract of land dated May 12, 1981, be renewed for an additional term of five (5) years in accordance with the terms and conditions stated therein. 1. City, subject to the reservations set forth herein, does hereby lease to Department for recreational purposes the following described land and premises: Being part of a 1.23 acre tract out of Juan, Miguel, Pedro and Nepomuceno Delgado Four League Grant, Abstract No. 4 conveyed by 5. Finley Ewing to James H. Ewing by Deed dated May 5, 1941, recorded in Volume 128, Page 53, Deed Records of San Patricio County, Texas, and being the same property conveyed by Guaranty Title and Trust Company, Trustee to Clyde D. Staves, by Deed dated May 17, 1960, recorded in Volume 255, Page 433, Deed Records of San Patricio County, Texas, and further being the same property as described in that certain Deed dated October 11, 1960, signed by Clyde D. Staves as Grantor to W. R. Hubler and Ed Byrne, which deed is recorded in Volume 262, Page 602-04 of the Deed Records of San Patricio County, Texas, and further being the same property as described in that certain Deed dated June 11, 1981, signed by W. R. Hubler and Ed Byrne as Grantors to the City of Corpus Christi, Texas, which deed is recorded in Volume 635, Page 71-73 of the Deed Records of San Patricio County, Texas, to which reference is here made. 2. The term of said lease shall be five years, beginning May 12, 1986 and ending May 11, 1991, and may be renewed for additional teens up to five years upon agreement of the parties. 3. Reference is made to the following previous leases by the City of property at Lake Corpus Christi: a. Lease to the State of Texas executed February 13, 1934, as it appears in Volume 59, page 623 of the Deed Records of Live Oak County, Texas. b. Instrument dated October 26, 1944, clarifying said February 13, 1934, lease agreement, as approved by Ordinance Number 1724, City of Corpus Christi, Texas. 05P.202.01 c. Lease to the State Parks Board of the State of Texas executed April 10, 1958, as approved by Ordinance Number 5008, City of Corpus Christi, Texas. Except for term of lease, this contract is subject, without exception, to every condition and reservation contained in any of the instruments referred to above. Executed this day of , 1986.
