AN ORDINANCE
CLOSING A PORTION OF WACO STREET FROM LIPAN STREET TO
MESTINA STREET BETWEEN BLOCKS 26 AND 41, BLUFF PORTION;
SUBJECT TO ANY ONE OF THE CONDITIONS LISTED BELOW.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of Waco Street from Lipan Street to Mestina Street between Blocks 26
and 41, Bluff Portion, was given by publication and mailed to the last known
addresses of the owners of property abutting the public way and within 450 feet
of the area proposed to be closed, and thereafter, pursuant to said notice,
public hearing was held at regular Council Meeting by the City Council of the
City of Corpus Christi on August 5, 1986, in accordance with the provisions of
the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will they be within the foreseeable future needed as public rights-of-way,
and that the same should be closed to vehicular traffic, subject to certain
specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed a portion of Waco Street from
Lipan Street to Mestina Street between Blocks 26 and 41, Bluff Portion, shown by
plat in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas, subject to
any one of the following conditions:
(a) the sale and conveyance of an interest in the 60 foot wide right-of-way to
Nueces County (Art. 5421C-12 VTCS) with such sale and conveyance being at
no less than the fair market value of said right-of-way;
(b) the closure and abandonment of the 60 foot wide right-of-way reverting to
the State of Texas and Nueces County subject to payment of the fair market
value of said right-of-way;
(c) the closure to vehicular traffic of all types and a lease agreement for a
period not to exceed 60 years be entered into with Nueces County for the
use of said right-of-way;
further providing that applicant for such closure action pay all costs
associated with closing existing intersections and relocating water, gas,
sanitary sewer, Central Power & Light and Southwestern Bell Telephone Company
facilities.
